House Comm: RCS . 04/01/2014 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— following: 1 Senate Amendment to Amendment (666098) (with title 2 amendment) 3 4 Delete lines 2449 - 2486 5 and insert: 6 (2) The chair or equivalent of the local general-purpose 7 government may convene a public hearing on the issue of 8 noncompliance, as well as general oversight of the special 9 district as provided in s. 189.068, within 6 months after 10 receipt of notice of noncompliance from the Legislative Auditing 11 Committee. 12 (3) Before the public hearing regarding the special 13 district’s noncompliance, the local general-purpose government 14 may request the following information from the special district: 15 (a) The special district’s annual financial report for the 16 previous fiscal year. 17 (b) The special district’s audit report for the previous 18 fiscal year. 19 (c) An annual report for the previous fiscal year, which 20 must provide a detailed review of the performance of the special 21 district and include the following information: 22 1. The purpose of the special district. 23 2. The sources of funding for the special district. 24 3. A description of the major activities, programs, and 25 initiatives the special district undertook in the most recently 26 completed fiscal year and the benchmarks or criteria under which 27 the success or failure of the special district was determined by 28 its governing body. 29 4. Any challenges or obstacles faced by the special 30 district in fulfilling its purpose and related responsibilities. 31 5. Ways the special district believes it could better 32 fulfill its purpose and related responsibilities and a 33 description of the actions that it intends to take during the 34 ensuing fiscal year. 35 6. Proposed changes to the ordinance that established the 36 special district and justification for such changes. 37 7. Any other information reasonably required to provide the 38 reviewing entity with an accurate understanding of the purpose 39 for which the special district exists and how it is fulfilling 40 its responsibilities to accomplish that purpose. 41 8. Any reasons for the special district’s noncompliance. 42 9. Whether the special district is currently in compliance. 43 10. Plans to correct any recurring issues of noncompliance. 44 11. Efforts to promote transparency, including maintenance 45 of the special district’s website in accordance with s. 189.069. 46 (4) The local general-purpose government shall report the 47 findings of any public hearing conducted under this section to 48 the department and the Legislative Auditing Committee within 6 49 months after the completion of such hearing. 50 51 ================= T I T L E A M E N D M E N T ================ 52 And the title is amended as follows: 53 Delete lines 3342 - 3355 54 and insert: 55 Auditing Committee and the chair or equivalent of a 56 local general-purpose government to convene a public 57 hearing on the issue of a special district’s 58 noncompliance and general oversight of the special 59 district; requiring a special district to provide 60 certain information to the Legislative Auditing 61 Committee before a public hearing upon request; 62 authorizing a local general-purpose government to 63 request certain information from a special district 64 created by local ordinance before a public hearing; 65 requiring a local general-purpose government to report 66 the findings of a public hearing to the department and 67 the Legislative Auditing Committee; creating s. 68 189.055, F.S.; requiring
