A bill to be entitled
2An act relating to driver license records; amending s.
3322.142, F.S.; revising the authorized uses of license
4identification information maintained by the Department of
5Highway Safety and Motor Vehicles and released to the
6Department of Children and Family Services; authorizing
7use for certain adult protective services investigations;
8providing conditions for such information to be used for
9verification of identity in determination of eligibility
10for public assistance and for certain fraud
11investigations; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (4) of section 322.142, Florida
16Statutes, is amended to read:
17 322.142 Color photographic or digital imaged licenses.-
18 (4) The department may maintain a film negative or print
19file. The department shall maintain a record of the digital
20image and signature of the licensees, together with other data
21required by the department for identification and retrieval.
22Reproductions from the file or digital record are exempt from
23the provisions of s. 119.07(1) and shall be made and issued only
24for departmental administrative purposes; for the issuance of
25duplicate licenses; in response to law enforcement agency
26requests; to the Department of State pursuant to an interagency
27agreement to facilitate determinations of eligibility of voter
28registration applicants and registered voters in accordance with
29ss. 98.045 and 98.075; to the Department of Revenue pursuant to
30an interagency agreement for use in establishing paternity and
31establishing, modifying, or enforcing support obligations in
32Title IV-D cases; to the Department of Children and Family
33Services pursuant to an interagency agreement to conduct
34protective investigations under part III of chapter 39 and
35chapter 415; to the Department of Children and Family Services
36pursuant to an interagency agreement specifying the number of
37employees in each of that department's regions to be granted
38access to the records for use as verification of identity to
39expedite the determination of eligibility for public assistance
40and for use in public assistance fraud investigations; or to the
41Department of Financial Services pursuant to an interagency
42agreement to facilitate the location of owners of unclaimed
43property, the validation of unclaimed property claims, and the
44identification of fraudulent or false claims.
45 Section 2. This act shall take effect July 1, 2010.
