A bill to be entitled
2An act relating to public school transportation; amending
3s. 1006.22, F.S.; authorizing district school boards to
4designate and use certain elementary schools as
5transportation hubs; amending s. 1006.23, F.S.; revising
6provisions relating to hazardous walking conditions to
7conform to changes made by the act; amending s. 1006.25,
8F.S.; providing for district school board policies that
9authorize private advertisements on school buses;
10providing for payment of an advertisement fee and use of
11the fee by the district school board; requiring State
12Board of Education rules relating to display of
13advertisements; amending s. 1011.68, F.S.; revising
14requirements for funding the transportation of students;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Paragraph (d) is added to subsection (12) of
20section 1006.22, Florida Statutes, to read:
21 1006.22 Safety and health of students being transported.-
22Maximum regard for safety and adequate protection of health are
23primary requirements that must be observed by district school
24boards in routing buses, appointing drivers, and providing and
25operating equipment, in accordance with all requirements of law
26and rules of the State Board of Education in providing
27transportation pursuant to s. 1006.21:

29 (d) Each district school board, after considering
30recommendations from the district school superintendent, may
31designate, by map or otherwise, or may provide by district
32school board rule for the designation of, transportation hubs
33composed of elementary schools located in the school district
34that shall be used as established bus stops from which middle
35school and high school students shall be transported to their
36designated school locations. A transportation hub shall be
37designated as an official bus stop on a specific route to be
38traveled regularly by a school bus pursuant to paragraph (b).
39 Section 2. Subsection (3) of section 1006.23, Florida
40Statutes, is amended to read:
41 1006.23 Hazardous walking conditions.-
42 (3) IDENTIFICATION OF HAZARDOUS CONDITIONS.-When a request
43for review is made to the district school superintendent or the
44district school superintendent's designee concerning a condition
45perceived to be hazardous to students in that district who walk
46to school, are in kindergarten through grade 5, and live within
47the 2-mile limit or and who walk to school, are in grades 6
48through 12, and live within the 3-mile limit, such condition
49shall be inspected by a representative of the school district
50and a representative of the state or local governmental entity
51that has jurisdiction over the perceived hazardous location. The
52district school superintendent or his or her designee and the
53state or local governmental entity or its representative shall
54then make a final determination that is mutually agreed upon
55regarding whether the hazardous condition meets the state
56criteria pursuant to this section. The district school
57superintendent or his or her designee shall report this final
58determination to the department.
59 Section 3. Subsection (5) is added to section 1006.25,
60Florida Statutes, to read:
61 1006.25 School buses.-School buses shall be defined and
62meet specifications as follows:
63 (5) ADVERTISEMENTS.-
64 (a) Private advertisements may be placed on the exterior
65of a school bus according to district school board policies that
66require the following:
67 1. Any individual or business entity may advertise on a
68school bus by paying a fee to be set by the district school
69board. Up to 5 percent of the fee collected may be used to pay
70advertising agency costs. The remainder of the fee shall be used
71by the district school board for school transportation purposes.
72 2. Only one individual or business entity may place
73advertisements on a school bus.
74 (b) The design, placement, and size of signage on the
75exterior of a school bus acknowledging the advertiser shall be
76prescribed by rule of the State Board of Education.
77 Section 4. Paragraph (a) of subsection (1) of section
781011.68, Florida Statutes, is amended to read:
79 1011.68 Funds for student transportation.-The annual
80allocation to each district for transportation to public school
81programs, including charter schools as provided in s.
821002.33(17)(b), of students in membership in kindergarten
83through grade 12 and in migrant and exceptional student programs
84below kindergarten shall be determined as follows:
85 (1) Subject to the rules of the State Board of Education,
86each district shall determine the membership of students who are
87transported:
88 (a)1. By reason of living 2 miles or more from an
89elementary school that enrolls any combination of students in
90kindergarten through grade 5.
91 2. By reason of living 3 miles or more from a middle
92school or a high school that enrolls any combination of students
93in grades 6 through 12.
94 Section 5. This act shall take effect July 1, 2010.
