HB 785

1	A bill to be entitled
2	An act relating to procurement of commodities and
3	contractual services; creating s. 287.05705, F.S.;
4	providing that an agency, county, or municipality that is
5	required to make purchases of commodities or contractual
6	services through competitive solicitation must provide
7	vendors the option to submit competitive sealed bids
8	through a uniform secure electronic interactive Internet
9	system; requiring specified notification in invitations to
10	bid; requiring the Department of Management Services to
11	adopt rules establishing procedures and requirements for
12	the electronic submission, receipt, and processing of
13	competitive sealed bids; providing exemptions; providing
14	an effective date.

16	Be It Enacted by the Legislature of the State of Florida:

18	Section 1. Section 287.05705, Florida Statutes, is created
19	to read:
20	287.05705 Online submission of competitive sealed bids.-
21	(1) Except as provided in subsections (4) and (5), an
22	agency, county, or municipality that is required to make
23	purchases of commodities or contractual services through
24	competitive solicitation must provide vendors the option to
25	submit competitive sealed bids through a uniform secure
26	electronic interactive Internet system.
27	(2) Agencies, counties, and municipalities must include in
28	invitations to bid notification to vendors apprising them of the
29	option to submit sealed bids electronically and of any special
30	conditions, requirements, or procedures particular to electronic
31	submissions of competitive sealed bids.
32	(3) The department shall adopt rules establishing
33	procedures and requirements for the electronic submission,
34	receipt, and processing of competitive sealed bids under this
35	section.
36	(4) A county or municipality that is without available
37	high-speed Internet access is exempt from the requirements of
38	subsections (1) and (2) until such time as high-speed Internet
39	access becomes available to the county or municipality.
40	(5) A county or municipality with a population of less
41	than 25,000 is exempt from the requirements of subsections (1)
42	and (2).
43	Section 2. This act shall take effect July 1, 2010.
