A bill to be entitled
2An act relating to jury system administration; amending s.
340.001, F.S.; authorizing the chief judge to designate the
4court administrator to perform certain duties relating to
5jury system management and operation; amending s. 40.02,
6F.S.; revising authority of the chief judge to designate
7the court administrator to perform certain duties;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 40.001, Florida Statutes, is amended to
13read:
14 40.001 Chief judge; authority; duties.-The chief judge of
15each judicial circuit is vested with overall authority and
16responsibility for the management, operation, and oversight of
17the jury system within his or her circuit. Notwithstanding
18However, in accordance with this chapter and chapter 905, the
19chief judge may designate the court administrator to perform
20specific duties relating to the management and operation of the
21jury system. If the chief judge does not make such designation,
22in accordance with this chapter and chapter 905, the clerk of
23the circuit court has specific responsibilities regarding the
24processing of jurors, including, but not limited to,
25qualifications, summons, selection lists, reporting, and
26compensation of jurors. The clerk of the circuit court may
27contract with the chief judge for the court's assistance in the
28provision of services to process jurors. The chief judge may
29also designate to the clerk of the circuit court additional
30duties consistent with established uniform standards of jury
31management practices that the Supreme Court may adopt by rule or
32issue through administrative order.
33 Section 2. Subsection (3) of section 40.02, Florida
34Statutes, is amended to read:
35 40.02 Selection of jury lists.-
36 (3) The clerk of the court shall perform the duties set
37forth in this section and in ss. 40.221, 40.23, and 40.231 in
38counties having an approved, computerized jury selection system,
39the provisions of any special law or general law of local
40application to the contrary notwithstanding. However, the chief
41judge may designate the court administrator to perform these
42duties if the county provides funding is obtained by the chief
43judge from any source to the court administrator to provide the
44personnel and other costs associated with jury services.
45 Section 3. This act shall take effect July 1, 2010.
