7 | athletic coach or an athletic director; providing an |
8 | exception; providing for a defense; authorizing the State |
9 | Board of Education and the Board of Governors to adopt |
10 | rules; providing an effective date. |

12 | Be It Enacted by the Legislature of the State of Florida: |
13 | |
14 | Section 1. Section 1006.72, Florida Statutes, is created |
15 | to read: |
16 | 1006.72 Diversity in hiring of athletic coaches and |
17 | athletic directors.- |
18 | (1) For purposes of this section, the term "minority |
19 | applicant" means an applicant who is: |
20 | (a) A person having origins in any of the black racial |
21 | groups of Africa; |
22 | (b) A person having origins in the Hispanic culture; |
23 | (c) A person having origins in any of the original peoples |
24 | of the Far East, Southeast Asia, the Indian Subcontinent, or the |
25 | Pacific Islands; or |
26 | (d) An American Indian or Alaskan Native having origins in |
27 | any of the original peoples of North America. |
28 | (2) Each state university or Florida college must |
29 | interview one or more qualified minority applicants when hiring |
30 | a head athletic coach or an athletic director unless the |
31 | institution is unable to identify a qualified minority applicant |
32 | who is willing to interview for the position. It is an |
33 | affirmative defense to a claim of a violation of this subsection |
34 | that the institution, in good faith, was unable to identify a |
35 | qualified minority applicant who was willing to interview for |
36 | the position. |
37 | (3) The State Board of Education and the Board of |
38 | Governors may adopt rules pursuant to ss. 120.536(1) and 120.54 |
39 | to implement this section for the Florida College System and the |
40 | State University System, respectively. |
41 | Section 2. This act shall take effect July 1, 2010. |
