A bill to be entitled
2An act relating to diversity in hiring of athletic coaches
3and athletic directors; creating s. 1006.72, F.S.;
4defining the term "minority applicant"; requiring each
5state university or Florida college to interview one or
6more qualified minority applicants when hiring a head
7athletic coach or an athletic director; providing an
8exception; providing for a defense; authorizing the State
9Board of Education and the Board of Governors to adopt
10rules; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 1006.72, Florida Statutes, is created
15to read:
16 1006.72 Diversity in hiring of athletic coaches and
17athletic directors.-
18 (1) For purposes of this section, the term "minority
19applicant" means an applicant who is:
20 (a) A person having origins in any of the black racial
21groups of Africa;
22 (b) A person having origins in the Hispanic culture;
23 (c) A person having origins in any of the original peoples
24of the Far East, Southeast Asia, the Indian Subcontinent, or the
25Pacific Islands; or
26 (d) An American Indian or Alaskan Native having origins in
27any of the original peoples of North America.
28 (2) Each state university or Florida college must
29interview one or more qualified minority applicants when hiring
30a head athletic coach or an athletic director unless the
31institution is unable to identify a qualified minority applicant
32who is willing to interview for the position. It is an
33affirmative defense to a claim of a violation of this subsection
34that the institution, in good faith, was unable to identify a
35qualified minority applicant who was willing to interview for
36the position.
37 (3) The State Board of Education and the Board of
38Governors may adopt rules pursuant to ss. 120.536(1) and 120.54
39to implement this section for the Florida College System and the
40State University System, respectively.
41 Section 2. This act shall take effect July 1, 2010.
