9 | such programs and teachers' bonuses; revising provisions |
10 | relating to the distribution of bonuses for teachers who |
11 | provide instruction to such programs; amending s. 1007.35, |
12 | F.S.; revising provisions relating to the duties of the |
13 | Florida Partnership for Minority and Underrepresented |
14 | Student Achievement; requiring that the partnership, in |
15 | cooperation with the Department of Education, post an |
16 | annual report on the department's website regarding the |
17 | Advanced Placement Program; specifying the information |
18 | that such report must contain; providing an effective |
19 | date. |

21 | Be It Enacted by the Legislature of the State of Florida: |
22 | |
23 | Section 1. This act may be cited as the "High-Performing |
24 | Teacher Bonuses Act." |
25 | Section 2. Paragraphs (m), (n), and (o) of subsection (1) |
26 | of section 1011.62, Florida Statutes, are amended to read: |
27 | 1011.62 Funds for operation of schools.-If the annual |
28 | allocation from the Florida Education Finance Program to each |
29 | district for operation of schools is not determined in the |
30 | annual appropriations act or the substantive bill implementing |
31 | the annual appropriations act, it shall be determined as |
32 | follows: |
33 | (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR |
34 | OPERATION.-The following procedure shall be followed in |
35 | determining the annual allocation to each district for |
36 | operation: |
37 | (m) Calculation of additional full-time equivalent |
38 | membership based on international baccalaureate examination |
39 | scores of students.-A value of 0.16 full-time equivalent student |
40 | membership shall be calculated for each student enrolled in an |
41 | international baccalaureate course who receives a score of 4 or |
42 | higher on a subject examination. A value of 0.3 full-time |
43 | equivalent student membership shall be calculated for each |
44 | student who receives an international baccalaureate diploma. |
45 | Such value shall be added to the total full-time equivalent |
46 | student membership in basic programs for grades 9 through 12 in |
47 | the subsequent fiscal year. Each school district shall allocate |
48 | 100 percent of the funds received for international |
49 | baccalaureate instruction to the school whose students generate |
50 | such funds and within that school program that generates such |
51 | funds. Funds allocated in accordance with this paragraph shall |
52 | be expended solely for the payment of allowable costs associated |
53 | with the international baccalaureate program and bonuses for |
54 | teachers who provide international baccalaureate instruction. |
55 | Such allowable costs are only those associated with |
56 | international baccalaureate annual school fees, international |
57 | baccalaureate examination fees, and salaries and benefits for |
58 | school-based international baccalaureate coordinators; |
59 | supplemental books, instructional supplies, instructional |
60 | equipment, or instructional materials for international |
61 | baccalaureate courses; programs or activities that identify |
62 | prospective international baccalaureate students or prepare |
63 | prospective students to enroll in international baccalaureate |
64 | courses; and training or professional development for |
65 | international baccalaureate teachers. The bonus for |
66 | international baccalaureate teachers shall equal the |
67 | proportionate value of the 0.16 additional funding per eligible |
68 | student score minus allowable costs, or $50 per eligible student |
69 | score, whichever is greater. The teacher bonus in a school |
70 | designated with a grade of "D" or "F" shall be an additional |
71 | $500 if any one of the teacher's international baccalaureate |
72 | students scores 4 or higher on an international baccalaureate |
73 | examination. |

87 | Bonuses awarded to a teacher according to this paragraph shall |
88 | not exceed $2,000, except that the bonuses awarded to a teacher |
89 | in a school designated with a grade of "D" or "F" shall not |
90 | exceed $5,000, in any given school year and shall be in addition |
91 | to any regular wage or other bonus the teacher received or is |
92 | scheduled to receive. If funds received pursuant to this |
93 | paragraph are not sufficient to fully pay for teacher bonuses |
94 | after paying mandatory program and examination fees, a school |
95 | district may prorate all teacher bonuses proportionately to the |
96 | total funds available. |
97 | (n) Calculation of additional full-time equivalent |
98 | membership based on Advanced International Certificate of |
99 | Education examination scores of students.-A value of 0.16 full- |
100 | time equivalent student membership shall be calculated for each |
101 | student enrolled in a full-credit Advanced International |
102 | Certificate of Education course who receives a score of E or |
103 | higher on a subject examination. A value of 0.08 full-time |
104 | equivalent student membership shall be calculated for each |
105 | student enrolled in a half-credit Advanced International |
106 | Certificate of Education course who receives a score of E or |
107 | higher on a subject examination. A value of 0.3 full-time |
108 | equivalent student membership shall be calculated for each |
109 | student who receives an Advanced International Certificate of |
110 | Education diploma. Such value shall be added to the total full- |
111 | time equivalent student membership in basic programs for grades |
112 | 9 through 12 in the subsequent fiscal year. Each school district |
113 | shall allocate 100 percent of the funds received for Advanced |
114 | International Certificate of Education instruction to the school |
115 | whose students generate such funds and within that school |
116 | program that generates such funds. Funds allocated in accordance |
117 | with this paragraph shall be expended solely for the payment of |
118 | allowable costs associated with the Advanced International |
119 | Certificate of Education program and teacher bonuses. Such |
120 | allowable costs are only those associated with Advanced |
121 | International Certificate of Education annual school fees; |
122 | Advanced International Certificate of Education examination |
123 | fees; salaries and benefits for school-based Advanced |
124 | International Certificate of Education coordinators; |
125 | supplemental books, instructional supplies, instructional |
126 | equipment, or instructional materials for Advanced International |
127 | Certificate of Education courses; programs or activities that |
128 | identify prospective Advanced International Certificate of |
129 | Education students or prepare prospective students to enroll in |
130 | Advanced International Certificate of Education courses; and |
131 | training or professional development for Advanced International |
132 | Certificate of Education teachers. The teacher bonus shall equal |
133 | the proportionate value of the 0.16 or 0.08 additional funding |
134 | per eligible student score minus allowable costs, or $50 per |
135 | eligible student score, whichever is greater. The teacher bonus |
136 | in a school designated with a grade of "D" or "F" shall be an |
137 | additional $500 if any one of the teacher's Advanced |
138 | International Certificate of Education students scores E or |
139 | higher on an Advanced International Certificate of Education |

181 | (o) Calculation of additional full-time equivalent |
182 | membership based on college board advanced placement scores of |
183 | students.-A value of 0.16 full-time equivalent student |
184 | membership shall be calculated for each student enrolled in each |
185 | advanced placement course who receives a score of 3 or higher on |
186 | the College Board Advanced Placement Examination for the prior |
187 | year and added to the total full-time equivalent student |
188 | membership in basic programs for grades 9 through 12 in the |
189 | subsequent fiscal year. Each school district shall allocate 100 |
190 | percent of the funds received for Advanced Placement instruction |
191 | to the school that generates such funds. Funds allocated in |
192 | accordance with this paragraph shall be expended solely for the |
193 | payment of allowable costs associated with the Advanced |
194 | Placement Program and teacher bonuses. Such allowable costs are |
195 | only those associated with Advanced Placement examination fees; |
196 | salaries and benefits for school-based Advanced Placement |
197 | coordinators; supplemental books, instructional supplies, |
198 | instructional equipment, or instructional materials for Advanced |
199 | Placement courses; programs or activities that identify |
200 | prospective Advanced Placement students or prepare prospective |
201 | students to enroll in Advanced Placement courses; and training |
202 | or professional development for Advanced Placement teachers. The |
203 | teacher bonus shall equal the proportionate value of the 0.16 |
204 | additional funding per eligible student score minus allowable |
205 | costs, or $50 per eligible student score, whichever is greater. |
206 | The teacher bonus in a school designated with a grade of "D" or |
207 | "F" shall include an additional $500 per student for the |
208 | teacher's first four students who score 3 or higher on an |
209 | Advanced Placement examination. |

226 | Bonuses awarded to a teacher according to this paragraph shall |
227 | not exceed $2,000, except that the bonuses awarded to a teacher |
228 | in a school designated with a grade of "D" or "F" shall not |
229 | exceed $5,000, in any given school year and shall be in addition |
230 | to any regular wage or other bonus the teacher received or is |
231 | scheduled to receive. If funds received pursuant to this |
232 | paragraph are not sufficient to fully pay for teacher bonuses, a |
233 | school district may prorate all teacher bonuses proportionately |
234 | to the total funds available. |
235 | Section 3. Paragraph (l) is added to subsection (6) of |
236 | section 1007.35, Florida Statutes, to read: |
237 | 1007.35 Florida Partnership for Minority and |
238 | Underrepresented Student Achievement.- |
239 | (6) The partnership shall: |
240 | (l) In cooperation with the Department of Education, post |
241 | an annual report on the department's website on or before |
242 | January 15 of each year which delineates: |
243 | 1. The total number of teachers who participate in |
244 | professional development associated with Advanced Placement |
245 | courses, the registration fees associated with such professional |
246 | development, and the number and value of scholarships awarded by |
247 | the College Board for teacher participation in Advanced |
248 | Placement professional development. |
249 | 2. The number of students per school who enroll in |
250 | Advanced Placement courses, the number of Advanced Placement |
251 | courses in which such students enroll, the number and percentage |
252 | of students enrolled in such courses who take the Advanced |
253 | Placement examination that corresponds to each course, the |
254 | number and percentage of students enrolled in Advanced Placement |
255 | courses who take the Advanced Placement examination that |
256 | corresponds to each course and receive a score of 3 or higher, |
257 | and the number and percentage of students who take an Advanced |
258 | Placement examination without having enrolled in the |
259 | corresponding Advanced Placement course and earn a score of 3 or |
260 | higher. Such information shall be reported at the state level by |
261 | subject, race, and gender. |
262 | 3. The amount paid by the state for each examination and |
263 | the total rebates provided to each school for the administration |
264 | of the College Board Advanced Placement Examination. |
265 | Section 4. This act shall take effect July 1, 2010. |
