Florida Senate - 2021 CS for SB 240 By the Committee on Health Policy; and Senator Book 588-02670-21 2021240c1 1 A bill to be entitled 2 An act relating to donor human milk bank services; 3 creating s. 383.017, F.S.; providing legislative 4 intent; defining the term “donor human milk bank”; 5 requiring the Department of Health to establish 6 certain standards for the regulation of donor human 7 milk banks; requiring donor human milk banks to comply 8 with certain standards; requiring the department to 9 adopt rules; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 383.017, Florida Statutes, is created to 14 read: 15 383.017 Donor human milk banks.— 16 (1) It is the intent of the Legislature to protect the 17 health, safety, and welfare of human milk donors and recipients 18 of human milk donation and to encourage the use of donor human 19 milk and donor human milk derivatives. 20 (2) As used in this section, the term “donor human milk 21 bank” means any entity or organization operating within this 22 state which collects, processes, stores, tests, or distributes 23 donor human milk or donor human milk derivatives. 24 (3) The Department of Health shall establish minimum 25 standards for the regulation of donor human milk banks which 26 must address the following: 27 (a) The operation of a donor human milk bank that 28 facilitates the donation, processing, and distribution of donor 29 human milk and donor human milk derivatives; 30 (b) Procedures for donation and distribution of donor human 31 milk and donor human milk derivatives; and 32 (c) Testing of donor human milk and donor human milk 33 derivatives before donation, processing, and distribution to 34 ensure the absence of adulterants and other contaminants as 35 determined by the department. 36 (4) A donor human milk bank operating in this state shall 37 comply with the standards established by the department pursuant 38 to this section. 39 (5) The department shall adopt rules to implement this 40 section. 41 Section 2. This act shall take effect July 1, 2021.
