    1                        A bill to be entitled                      
    2         An act relating to animal cruelty; amending s. 828.12,
    3         F.S.; revising the elements necessary for a
    4         misdemeanor charge of animal cruelty; providing an
    5         effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Subsection (1) of section 828.12, Florida
   10  Statutes, is amended to read:
   11         828.12 Cruelty to animals.—
   12         (1) A person who:
   13         (a) Unnecessarily kills, overloads, overdrives, torments,
   14  or mutilates any animal, or causes the same to be done;
   15         (b) Deprives any animal of necessary sustenance or
   16  shelter;, or unnecessarily mutilates, or kills any animal, or
   17  causes the same to be done, or
   18         (c) Carries any animal in or upon any vehicle, or
   19  otherwise, any animal in a cruel or inhumane manner,
   20  
   21  commits animal cruelty, a misdemeanor of the first degree,
   22  punishable as provided in s. 775.082 or by a fine of not more
   23  than $5,000, or both.
   24         Section 2. This act shall take effect October 1, 2022.
