Florida Senate - 2019 SB 280 By Senator Albritton 26-00855-19 2019280__ 1 A bill to be entitled 2 An act relating to the placement of instructional 3 personnel; amending s. 1012.34, F.S.; prohibiting the 4 use of a specified student learning growth formula as 5 the only factor in determining the placement of 6 certain instructional personnel; providing an 7 effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Paragraph (a) of subsection (7) of section 12 1012.34, Florida Statutes, is amended to read: 13 1012.34 Personnel evaluation procedures and criteria.— 14 (7) MEASUREMENT OF STUDENT PERFORMANCE.— 15 (a) The Commissioner of Education shall approve a formula 16 to measure individual student learning growth on the statewide, 17 standardized assessments in English Language Arts and 18 mathematics administered under s. 1008.22. A third party, 19 independent of the assessment developer, must analyze student 20 learning growth data calculated using the formula and provide 21 access to a data visualization tool that enables teachers to 22 understand and evaluate the data and school administrators to 23 improve instruction, evaluate programs, allocate resources, plan 24 professional development, and communicate with stakeholders. The 25 formula may not be the only factor used to determine the 26 placement of a classroom teacher, as defined in s. 27 1012.01(2)(a), and other instructional staff, as defined in s. 28 1012.01(2)(d). The formula must take into consideration each 29 student’s prior academic performance. The formula must not set 30 different expectations for student learning growth based upon a 31 student’s gender, race, ethnicity, or socioeconomic status. In 32 the development of the formula, the commissioner shall consider 33 other factors such as a student’s attendance record, disability 34 status, or status as an English language learner. The 35 commissioner may select additional formulas to measure student 36 performance as appropriate for the remainder of the statewide, 37 standardized assessments included under s. 1008.22 and continue 38 to select formulas as new assessments are implemented in the 39 state system. 40 Section 2. This act shall take effect July 1, 2019.
