    2         An act relating to energy; amending s. 286.29, F.S.;
    3         revising the selection criteria for purchasing or
    4         leasing vehicles for state agencies, state
    5         universities, community colleges, and local
    6         governments under a state purchasing plan; specifying
    7         that, if available, a state agency must use certain
    8         fuels in vehicles with internal combustion engines;
    9         requiring the Department of Management Services,
   10         before a specified date, to make recommendations to
   11         state agencies, state universities, community
   12         colleges, and local governments relating to the
   13         procurement and integration of electric and natural
   14         gas fuel vehicles and other vehicles powered by
   15         renewable energy; providing an effective date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18  
   19         Section 1. Subsections (4) and (5) of section 286.29,
   20  Florida Statutes, are amended to read:
   21         286.29 Climate-friendly public business.—The Legislature
   22  recognizes the importance of leadership by state government in
   23  the area of energy efficiency and in reducing the greenhouse gas
   24  emissions of state government operations. The following shall
   25  pertain to all state agencies when conducting public business:
   26         (4) When procuring new vehicles, all state agencies, state
   27  universities, community colleges, and local governments that
   28  purchase vehicles under a state purchasing plan shall first
   29  define the intended purpose for the vehicle and determine which
   30  of the following use classes for which the vehicle is being
   31  procured:
   32         (a) State business travel, designated operator;
   33         (b) State business travel, pool operators;
   34         (c) Construction, agricultural, or maintenance work;
   35         (d) Conveyance of passengers;
   36         (e) Conveyance of building or maintenance materials and
   37  supplies;
   38         (f) Off-road vehicle, motorcycle, or all-terrain vehicle;
   39         (g) Emergency response; or
   40         (h) Other.

   42  Vehicles described in paragraphs (a) through (h), when being
   43  processed for purchase or leasing agreements, must be selected
   44  based on the lowest lifetime ownership costs, including costs
   45  for operations, maintenance, and fuel when fuel economy data is
   46  available, for the greatest fuel efficiency available for a
   47  given use class when fuel economy data are available. Exceptions
   48  may be made for individual vehicles in paragraph (g) when
   49  accompanied, during the procurement process, by documentation
   50  indicating that the operator or operators will exclusively be
   51  emergency first responders or have special documented need for
   52  exceptional vehicle performance characteristics. Any request for
   53  an exception must be approved by the purchasing agency head and
   54  any exceptional performance characteristics denoted as a part of
   55  the procurement process prior to purchase.
   56         (5) When a state agency purchases a vehicle with an
   57  internal combustion engine, it must All state agencies shall use
   58  ethanol and biodiesel blended and natural gas fuels when
   59  available. State agencies administering central fueling
   60  operations for state-owned vehicles with an internal combustion
   61  engine shall procure biofuels for fleet needs to the greatest
   62  extent practicable.
   63         Section 2. Before July 1, 2024, the Department of
   64  Management Services shall make recommendations to state
   65  agencies, state universities, community colleges, and local
   66  governments regarding the procurement of electric and natural
   67  gas fuel vehicles and other vehicles powered by renewable energy
   68  as defined in s. 366.91(2), Florida Statutes, and best practices
   69  for integrating such vehicles into existing fleets.
   70         Section 3. This act shall take effect July 1, 2023.
