Florida Senate - 2023 CS for CS for SB 284 By the Committees on Finance and Tax; and Governmental Oversight and Accountability; and Senator Brodeur 593-02552-23 2023284c2 1 A bill to be entitled 2 An act relating to energy; amending s. 286.29, F.S.; 3 revising the selection criteria for purchasing or 4 leasing vehicles for state agencies, state 5 universities, community colleges, and local 6 governments under a state purchasing plan; specifying 7 that, if available, a state agency must use certain 8 fuels in vehicles with internal combustion engines; 9 requiring the Department of Management Services, 10 before a specified date, to make recommendations to 11 state agencies, state universities, community 12 colleges, and local governments relating to the 13 procurement and integration of electric and natural 14 gas fuel vehicles and other vehicles powered by 15 renewable energy; amending s. 553.791, F.S.; revising 16 the definition of the term “single-trade inspection”; 17 providing an effective date. 18 19 Be It Enacted by the Legislature of the State of Florida: 20 21 Section 1. Subsections (4) and (5) of section 286.29, 22 Florida Statutes, are amended to read: 23 286.29 Climate-friendly public business.—The Legislature 24 recognizes the importance of leadership by state government in 25 the area of energy efficiency and in reducing the greenhouse gas 26 emissions of state government operations. The following shall 27 pertain to all state agencies when conducting public business: 28 (4) When procuring new vehicles, all state agencies, state 29 universities, community colleges, and local governments that 30 purchase vehicles under a state purchasing plan shall first 31 define the intended purpose for the vehicle and determine which 32 of the following use classes for which the vehicle is being 33 procured: 34 (a) State business travel, designated operator; 35 (b) State business travel, pool operators; 36 (c) Construction, agricultural, or maintenance work; 37 (d) Conveyance of passengers; 38 (e) Conveyance of building or maintenance materials and 39 supplies; 40 (f) Off-road vehicle, motorcycle, or all-terrain vehicle; 41 (g) Emergency response; or 42 (h) Other. 43 44 Vehicles described in paragraphs (a) through (h), when being 45 processed for purchase or leasing agreements, must be selected 46 based on the lowest lifetime ownership costs, including costs 47 for operations, maintenance, and fuel when fuel economy data is 48 available,for the greatest fuel efficiency availablefor a 49 given use classwhen fuel economy data are available. Exceptions 50 may be made for individual vehicles in paragraph (g) when 51 accompanied, during the procurement process, by documentation 52 indicating that the operator or operators will exclusively be 53 emergency first responders or have special documented need for 54 exceptional vehicle performance characteristics. Any request for 55 an exception must be approved by the purchasing agency head and 56 any exceptional performance characteristics denoted as a part of 57 the procurement process prior to purchase. 58 (5) When a state agency purchases a vehicle with an 59 internal combustion engine, it mustAll state agenciesshalluse 60 ethanol and biodiesel blended and natural gas fuels when 61 available. State agencies administering central fueling 62 operations for state-owned vehicles with an internal combustion 63 engine shall procure biofuels for fleet needs to the greatest 64 extent practicable. 65 Section 2. Before July 1, 2024, the Department of 66 Management Services shall make recommendations to state 67 agencies, state universities, community colleges, and local 68 governments regarding the procurement of electric and natural 69 gas fuel vehicles and other vehicles powered by renewable energy 70 as defined in s. 366.91(2), Florida Statutes, and best practices 71 for integrating such vehicles into existing fleets. 72 Section 3. Paragraph (p) of subsection (1) of section 73 553.791, Florida Statutes, is amended to read: 74 553.791 Alternative plans review and inspection.— 75 (1) As used in this section, the term: 76 (p) “Single-trade inspection” means any inspection focused 77 on a single construction trade, such as plumbing, mechanical, or 78 electrical. The term includes, but is not limited to, 79 inspections of door or window replacements; fences and block 80 walls more than 6 feet high from the top of the wall to the 81 bottom of the footing; stucco or plastering; reroofing with no 82 structural alteration; HVAC replacements; installation of 83 electric vehicle charging stations; solar energy and energy 84 storage installations or alterations; ductwork or fan 85 replacements; alteration or installation of wiring, lighting, 86 and service panels; water heater changeouts; sink replacements; 87 and repiping. 88 Section 4. This act shall take effect July 1, 2023.
