Florida Senate - 2017 CS for SB 404 By the Committee on Rules; and Senator Simmons 595-03520-17 2017404c1 1 A bill to be entitled 2 An act relating to ratification of Department of 3 Financial Services rules; ratifying specified rules 4 relating to the Florida Workers’ Compensation 5 Reimbursement Manual for Hospitals and Florida 6 Workers’ Compensation Reimbursement Manual for 7 Ambulatory Surgical Centers for the sole and exclusive 8 purpose of satisfying any condition on effectiveness 9 imposed under s. 120.541(3), F.S., which requires 10 ratification of any rule exceeding the specified 11 thresholds for likely adverse impact or increase in 12 regulatory costs; providing construction; providing 13 for a certain notice in the Florida Administrative 14 Code, the Florida Administrative Register, or both; 15 providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. (1) The following rules are ratified for the 20 sole and exclusive purpose of satisfying any condition on 21 effectiveness imposed under s. 120.541(3), Florida Statutes: 22 rule 69L-7.501, Florida Administrative Code, titled “Florida 23 Workers’ Compensation Reimbursement Manual for Hospitals,” and 24 rule 69L-7.100, Florida Administrative Code, titled “Florida 25 Workers’ Compensation Reimbursement Manual for Ambulatory 26 Surgical Centers,” as filed for adoption with the Department of 27 State pursuant to the certification package dated December 19, 28 2016. 29 (2) This act serves no other purpose and shall not be 30 codified in the Florida Statutes. After this act becomes law, 31 its enactment and effective dates shall be noted in the Florida 32 Administrative Code, the Florida Administrative Register, or 33 both, as appropriate. This act does not alter rulemaking 34 authority delegated by prior law, does not constitute 35 legislative preemption of or exception to any provision of law 36 governing adoption or enforcement of the rule cited, and is 37 intended to preserve the status of any cited rule as a rule 38 under chapter 120, Florida Statutes. This act does not cure any 39 rulemaking defect or preempt any challenge based on a lack of 40 authority or a violation of the legal requirements governing the 41 adoption of any rule cited. 42 Section 2. This act shall take effect July 1, 2017.
