Florida Senate - 2012 SB 558 By Senator Hays 20-00605-12 2012558__ 1 A bill to be entitled 2 An act relating to the land application of septage; 3 amending s. 381.0065, F.S.; terminating the future 4 imposition of the prohibition of the land application 5 of septage from onsite sewage treatment and disposal 6 systems; providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Subsection (7) of section 381.0065, Florida 11 Statutes, is amended to read: 12 381.0065 Onsite sewage treatment and disposal systems; 13 regulation.— 14(7) LAND APPLICATION OF SEPTAGE PROHIBITED.—Effective15January 1, 2016, the land application of septage from onsite16sewage treatment and disposal systems is prohibited. By February171, 2011, the department, in consultation with the Department of18Environmental Protection, shall provide a report to the19Governor, the President of the Senate, and the Speaker of the20House of Representatives, recommending alternative methods to21establish enhanced treatment levels for the land application of22septage from onsite sewage and disposal systems. The report23shall include, but is not limited to, a schedule for the24reduction in land application, appropriate treatment levels,25alternative methods for treatment and disposal, enhanced26application site permitting requirements including any27requirements for nutrient management plans, and the range of28costs to local governments, affected businesses, and individuals29for alternative treatment and disposal methods. The report shall30also include any recommendations for legislation or rule31authority needed to reduce land application of septage.32 Section 2. This act shall take effect July 1, 2012.
