Florida Senate - 2022 SB 600 By Senator Berman 31-00186B-22 2022600__ 1 A bill to be entitled 2 An act relating to upgrades to education facilities as 3 emergency shelters; amending s. 1013.372, F.S.; 4 exempting costs of less than $2 million associated 5 with certain upgrades to education facilities from 6 being included in certain cost per student station 7 calculations; specifying eligible updates that may be 8 made; prohibiting renewable energy source devices 9 located on the property of an education facility from 10 generating more than a specified amount of energy; 11 requiring costs associated with certain upgrades to be 12 consistent with prevailing market costs in the area 13 where the education facility is located; providing an 14 effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Present subsection (3) of section 1013.372, 19 Florida Statutes, is redesignated as subsection (4), and a new 20 subsection (3) is added to that section, to read: 21 1013.372 Education facilities as emergency shelters.— 22 (3) Any costs of less than $2 million associated with 23 upgrades to an education facility which are designed to improve 24 the capabilities of the facility to provide enhanced hurricane 25 protection areas in accordance with the Florida Building Code 26 may not be included in calculating the total cost per student 27 station for purposes of meeting the limits under s. 28 1013.64(6)(b). 29 (a) Eligible upgrades under this subsection are limited to 30 those necessary for an area to be designated as an enhanced 31 hurricane protection area; electrical and standby emergency 32 power systems as provided in the Florida Building Code; 33 renewable energy source devices as defined in s. 193.624(1); and 34 energy storage devices. A renewable energy source device located 35 on the property of an education facility may not generate a 36 cumulative amount of energy during a calendar year which is 37 greater than the energy that the facility consumes during the 38 calendar year. 39 (b) All costs associated with upgrades made pursuant to 40 this subsection must be consistent with prevailing market costs 41 in the area where the education facility is located. 42 Section 2. This act shall take effect July 1, 2022.
