    2         An act relating to trust funds; creating s. 551.317,
    3         F.S.; creating the Destination Resort Trust Fund
    4         within the Department of Gaming Control; providing for
    5         the purpose of the trust fund; providing for future
    6         review and termination or re-creation of the trust
    7         fund; providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 551.317, Florida Statutes, is created to
   12  read:
   13         551.317 Destination Resort Trust Fund.—
   14         (1) The Destination Resort Trust Fund is created within the
   15  Department of Gaming Control.
   16         (2) The trust fund is established for the deposit of
   17  licensing fees of destination resorts and the proceeds of gross
   18  receipts taxes imposed on destination resorts. Funds may be
   19  expended only pursuant to legislative appropriation or an
   20  approved amendment to the Department of Gaming Control’s
   21  operating budget pursuant to chapter 216, Florida Statutes.
   22         (3) In accordance with s. 19(f)(2), Art. III of the State
   23  Constitution, the trust fund shall, unless terminated sooner, be
   24  terminated on July 1, 2016. Before its scheduled termination,
   25  the trust fund shall be reviewed as provided in s. 215.3206(1)
   26  and (2).
   27         Section 2. This act shall take effect on the same date that
   28  SB 710 or similar legislation takes effect, if such legislation
   29  is enacted in the same legislative session, or an extension
   30  thereof, and becomes law, and only if this act is enacted by a
   31  three-fifths vote of the membership of each house of the
   32  Legislature.
