Florida Senate - 2020 SB 724 By Senator Albritton 26-00586A-20 2020724__ 1 A bill to be entitled 2 An act relating to local government recycling 3 programs; amending s. 403.706, F.S.; extending the 4 goal date for the recycling of 75 percent of 5 recyclable solid waste by counties other than fiscally 6 constrained counties; conforming a provision to 7 changes made by the act; requiring a report to the 8 Legislature by a specified date; making technical 9 changes; reenacting ss. 403.7049(5), 403.705(2)(c) and 10 (3), and 403.7145(3) F.S., relating to the 11 determination of full cost for solid waste management, 12 the state solid waste management program, and 13 recycling, respectively, to incorporate the amendment 14 made to s. 403.706, F.S., in references thereto; 15 providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Paragraphs (a), (d), and (e) of subsection (2) 20 of section 403.706, Florida Statutes, are amended to read: 21 403.706 Local government solid waste responsibilities.— 22 (2)(a) Each county shall implement a recyclable materials 23 recycling program that hasshall havea goal of recycling 24 recyclable solid waste by 40 percent by December 31, 2012; 50 25 percent by December 31, 2014; 60 percent by December 31, 2016; 26 70 percent by December 31, 2018; and 75 percent by December 31, 27 20242020. Counties and municipalities are encouraged to form 28 cooperative arrangements for implementing recycling programs. A 29 fiscally constrained county, as defined in s. 218.67(1), is 30 exempt from the goals set forth in this paragraph. 31 (d) If, by January 1, 2025, aof 2013, 2015, 2017, 2019, or322021, thecounty is, asdetermined by the department in 33 accordance with applicable rules to have failed to reach its,34has not reached therecycling goals established underas set35forth inparagraph (a), the department may direct the county to 36 develop a plan to expand recycling programs to existing 37 commercial and multifamily dwellings, including, but not limited 38 to, apartment complexes. 39 (e)If the state’s recycling rate for the 2013 calendar40year is below 40 percent; below 50 percent by January 1, 2015;41below 60 percent by January 1, 2017; below 70 percent by January421, 2019; or below 75 percent by January 1, 2021,The department 43 shall provide a report to the President of the Senate and the 44 Speaker of the House of Representatives by January 1, 2021. The 45 report shall identify anythoseadditional programs or statutory 46 changes needed to achieve the goals established underset forth47inparagraph (a). The reportshall be providedno later than 3048daysprior tothe beginning of the regular session of the49Legislature.The department is not required to provide a report50to the Legislature if the state reaches its recycling goalsas51described in this paragraph. 52 Section 2. For the purpose of incorporating the amendment 53 made by this act to section 403.706, Florida Statutes, in a 54 reference thereto, subsection (5) of section 403.7049, Florida 55 Statutes, is reenacted to read: 56 403.7049 Determination of full cost for solid waste 57 management; local solid waste management fees.— 58 (5) In order to assist in achieving the municipal solid 59 waste reduction goal and the recycling provisions of s. 60 403.706(2), a county or a municipality which owns or operates a 61 solid waste management facility is hereby authorized to charge 62 solid waste disposal fees which may vary based on a number of 63 factors, including, but not limited to, the amount, 64 characteristics, and form of recyclable materials present in the 65 solid waste that is brought to the county’s or the 66 municipality’s facility for processing or disposal. 67 Section 3. For the purpose of incorporating the amendment 68 made by this act to section 403.706, Florida Statutes, in 69 references thereto, paragraph (c) of subsection (2) and 70 subsection (3) of section 403.705, Florida Statutes, are 71 reenacted to read: 72 403.705 State solid waste management program.— 73 (2) The state solid waste management program shall include, 74 at a minimum: 75 (c) Planning guidelines and technical assistance to 76 counties and municipalities to aid in meeting the municipal 77 solid waste recycling goals established in s. 403.706(2). 78 (3) The department shall evaluate and report biennially to 79 the President of the Senate and the Speaker of the House of 80 Representatives on the state’s success in meeting the solid 81 waste recycling goal as described in s. 403.706(2). 82 Section 4. For the purpose of incorporating the amendment 83 made by this act to section 403.706, Florida Statutes, in a 84 reference thereto, subsection (3) of section 403.7145, Florida 85 Statutes, is reenacted to read: 86 403.7145 Recycling.— 87 (3) The department shall develop and contract for an 88 innovative recycling pilot project for the Capitol recycling 89 area. The project shall be designed to collect recyclable 90 materials and create a more sustainable recycling system. 91 Components of the project shall be designed to increase 92 convenience, incentivize and measure participation, reduce 93 material volume, and assist in achieving the recycling goals 94 enumerated in s. 403.706. 95 Section 5. This act shall take effect July 1, 2020.
