Florida Senate - 2012 SB 1106 By Senator Altman 24-00670-12 20121106__ 1 A bill to be entitled 2 An act relating to electric energy production; 3 amending s. 366.02, F.S.; revising the definition of 4 the term “public utility” to exclude certain renewable 5 solar energy production facilities for purposes of 6 specified provisions; amending s. 366.91, F.S.; 7 revising the definition of the term “net metering” for 8 purposes of provisions relating to renewable energy; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (1) of section 366.02, Florida 14 Statutes, is amended to read: 15 366.02 Definitions.—As used in this chapter: 16 (1) “Public utility” means every person, corporation, 17 partnership, association, or other legal entity and their 18 lessees, trustees, or receivers supplying electricity or gas 19 (natural, manufactured, or similar gaseous substance) to or for 20 the public within this state; but the term “public utility” does 21 not includeeithera cooperative now or hereafter organized and 22 existing under the Rural Electric Cooperative Law of the state; 23 a municipality or any agency thereof; an entity that produces 24 and sells 5 megawatts or less per hour of renewable solar 25 energy, as defined in s. 377.803(6), to users located on the 26 property adjacent to or contiguous with the renewable energy 27 production facility; any dependent or independent special 28 natural gas district; any natural gas transmission pipeline 29 company making only sales or transportation delivery of natural 30 gas at wholesale and to direct industrial consumers; any entity 31 selling or arranging for sales of natural gas which neither owns 32 nor operates natural gas transmission or distribution facilities 33 within the state; or a person supplying liquefied petroleum gas, 34 in either liquid or gaseous form, irrespective of the method of 35 distribution or delivery, or owning or operating facilities 36 beyond the outlet of a meter through which natural gas is 37 supplied for compression and delivery into motor vehicle fuel 38 tanks or other transportation containers, unless such person 39 also supplies electricity or manufactured or natural gas. 40 Section 2. Paragraph (c) of subsection (2) of section 41 366.91, Florida Statutes, is amended to read: 42 366.91 Renewable energy.— 43 (2) As used in this section, the term: 44 (c) “Net metering” means a metering and billing methodology 45 whereby customer-owned renewable generation is allowed to offset 46 the customer’s electricity consumption on site, and the 47 customer’s site includes all of the customer’s energy usage 48 accounts located on contiguous property owned by the same 49 customer. 50 Section 3. This act shall take effect July 1, 2012.
