Florida Senate - 2014 SB 1170 By Senator Dean 5-00648-14 20141170__ 1 A bill to be entitled 2 An act relating to slot machine licenses; amending s. 3 551.104, F.S.; requiring a harness racing permitholder 4 that is applying for a slot machine license to file 5 with the Division of Pari-mutuel Wagering a written 6 agreement between the applicant and the Florida 7 Standardbred Breeders and Owners Association which 8 governs certain purses and awards; requiring sums for 9 awards to be remitted monthly; providing an effective 10 date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraph (a) of subsection (10) of section 15 551.104, Florida Statutes, is amended to read: 16 551.104 License to conduct slot machine gaming.— 17 (10)(a)1. ANoslot machine license or renewal thereof may 18 notshallbe issued to an applicant holding a permit under 19 chapter 550 to conduct pari-mutuel wagering meets of 20 thoroughbred racing unless the applicant has on file with the 21 division a binding written agreement between the applicant and 22 the Florida Horsemen’s Benevolent and Protective Association, 23 Inc., governing the payment of purses on live thoroughbred races 24 conducted at the licensee’s pari-mutuel facility. In addition, a 25noslot machine license or renewal thereof may notshallbe 26 issued to such an applicant unless the applicant has on file 27 with the division a binding written agreement between the 28 applicant and the Florida Thoroughbred Breeders’ Association,29Inc.,governing the payment of breeders’, stallion, and special 30 racing awards on live thoroughbred races conducted at the 31 licensee’s pari-mutuel facility. The agreement governing purses 32 and the agreement governing awards may direct the payment of 33 such purses and awards from revenues generated by any wagering 34 or gaming the applicant is authorized to conduct under Florida 35 law.AllPurses and awards areshall besubject tothe terms of36 chapter 550. All sums for breeders’, stallion, and special 37 racing awards mustshallbe remitted monthly to the Florida 38 Thoroughbred Breeders’ Association, Inc.,for the payment of 39 awards subject to the administrative fee authorized in s. 40 550.2625(3). 41 2. ANoslot machine license or renewal thereof may not 42shallbe issued to an applicant holding a permit under chapter 43 550 to conduct pari-mutuel wagering meets of quarter horse 44 racing unless the applicant has on file with the division a 45 binding written agreement between the applicant and the Florida 46 Quarter Horse Racing Association or the association representing 47 a majority of the horse owners and trainers at the applicant’s 48 eligible facility, governing the payment of purses on live 49 quarter horse races conducted at the licensee’s pari-mutuel 50 facility. The agreement governing purses may direct the payment 51 of such purses from revenues generated by any wagering or gaming 52 the applicant is authorized to conduct under Florida law.All53 Purses areshall besubject tothe terms ofchapter 550. 54 3. A slot machine license or renewal thereof may not be 55 issued to an applicant holding a permit under chapter 550 to 56 conduct pari-mutuel wagering meets of harness racing unless the 57 applicant has on file with the division a binding written 58 agreement between the applicant and the Florida Standardbred 59 Breeders and Owners Association governing the payment of purses 60 on live harness races conducted at the licensee’s pari-mutuel 61 facility. In addition, a slot machine license or renewal thereof 62 may not be issued to such an applicant unless the applicant has 63 on file with the division a binding written agreement between 64 the applicant and the Florida Standardbred Breeders and Owners 65 Association governing the payment of breeders’ and stallion 66 awards on live harness races conducted at the licensee’s pari 67 mutuel facility. The agreement governing purses and the 68 agreement governing awards may direct the payment of such purses 69 and awards from revenues generated by any wagering or gaming the 70 applicant is authorized to conduct under Florida law. Purses and 71 awards are subject to chapter 550. All sums for breeders’ and 72 stallion awards must be remitted monthly to the Florida 73 Standardbred Breeders and Owners Association for the payment of 74 awards subject to the administrative fee authorized in s. 75 550.2625(4). 76 Section 2. This act shall take effect July 1, 2014.
