    2         An act relating to law enforcement vehicles; amending
    3         s. 338.155, F.S.; exempting a law enforcement officer
    4         operating an unmarked vehicle while on official law
    5         enforcement business from paying the toll at a toll
    6         facility; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (1) of section 338.155, Florida
   11  Statutes, is amended to read:
   12         338.155 Payment of toll on toll facilities required;
   13  exemptions.—
   14         (1) A person who uses No persons are permitted to use any
   15  toll facility must pay the toll without payment of tolls, except
   16  employees of the agency operating the toll project when using
   17  the toll facility on official state business, state military
   18  personnel while on official military business, handicapped
   19  persons as provided in this section, persons exempt from toll
   20  payment by the authorizing resolution for bonds issued to
   21  finance the facility, and persons exempt on a temporary basis
   22  where use of such toll facility is required as a detour route.
   23  Any law enforcement officer operating a marked or unmarked
   24  official vehicle is exempt from toll payment when on official
   25  law enforcement business. Any person operating a fire vehicle
   26  when on official business or a rescue vehicle when on official
   27  business is exempt from toll payment. Any person participating
   28  in the funeral procession of a law enforcement officer or
   29  firefighter killed in the line of duty is exempt from toll
   30  payment. The secretary, or the secretary’s designee, may suspend
   31  the payment of tolls on a toll facility when necessary to assist
   32  in emergency evacuation. The failure to pay a prescribed toll
   33  constitutes a noncriminal traffic infraction, punishable as a
   34  moving violation pursuant to s. 318.18. The department may is
   35  authorized to adopt rules relating to the payment, collection,
   36  and enforcement of tolls, as authorized in chapters 316, 318,
   37  320, 322, and 338, including, but not limited to, rules for the
   38  implementation of video or other image billing and variable
   39  pricing.
   40         Section 2. This act shall take effect July 1, 2012.
