1 A bill to be entitled
2 An act relating to public school transportation;
3 amending s. 1006.22, F.S.; authorizing district school
4 boards to designate and use certain elementary schools
5 as transportation hubs; amending s. 1006.23, F.S.;
6 revising provisions relating to hazardous walking
7 conditions to conform to changes made by the act;
8 amending s. 1006.25, F.S.; providing for district
9 school board policies that authorize private
10 advertisements on school buses; providing for payment
11 of an advertisement fee and use of the fee by the
12 district school board; requiring State Board of
13 Education rules relating to display of advertisements;
14 amending s. 1011.68, F.S.; revising requirements for
15 funding the transportation of students; providing an
16 effective date.

18 Be It Enacted by the Legislature of the State of Florida:

20 Section 1. Paragraph (d) is added to subsection (12) of
21 section 1006.22, Florida Statutes, to read:
22 1006.22 Safety and health of students being transported.
23 Maximum regard for safety and adequate protection of health are
24 primary requirements that must be observed by district school
25 boards in routing buses, appointing drivers, and providing and
26 operating equipment, in accordance with all requirements of law
27 and rules of the State Board of Education in providing
28 transportation pursuant to s. 1006.21:

30 (d) Each district school board, after considering
31 recommendations from the district school superintendent, may
32 designate, by map or otherwise, or may provide by district
33 school board rule for the designation of, transportation hubs
34 composed of elementary schools located in the school district
35 that shall be used as established bus stops from which middle
36 school and high school students shall be transported to their
37 designated school locations. A transportation hub shall be
38 designated as an official bus stop on a specific route to be
39 traveled regularly by a school bus pursuant to paragraph (b).
40 Section 2. Subsection (3) of section 1006.23, Florida
41 Statutes, is amended to read:
42 1006.23 Hazardous walking conditions.—
43 (3) IDENTIFICATION OF HAZARDOUS CONDITIONS.—When a request
44 for review is made to the district school superintendent or the
45 district school superintendent’s designee concerning a condition
46 perceived to be hazardous to students in that district who walk
47 to school, are in kindergarten through grade 5, and live within
48 the 2-mile limit or and who walk to school, are in grades 6
49 through 12, and live within the 3-mile limit, such condition
50 shall be inspected by a representative of the school district
51 and a representative of the state or local governmental entity
52 that has jurisdiction over the perceived hazardous location. The
53 district school superintendent or his or her designee and the
54 state or local governmental entity or its representative shall
55 then make a final determination that is mutually agreed upon
56 regarding whether the hazardous condition meets the state
57 criteria pursuant to this section. The district school
58 superintendent or his or her designee shall report this final
59 determination to the department.
60 Section 3. Subsection (5) is added to section 1006.25,
61 Florida Statutes, to read:
62 1006.25 School buses.—School buses shall be defined and
63 meet specifications as follows:
64 (5) ADVERTISEMENTS.—
65 (a) Private advertisements may be placed on the exterior of
66 a school bus according to district school board policies that
67 require the following:
68 1. Any individual or business entity may advertise on a
69 school bus by paying a fee to be set by the district school
70 board. Up to 5 percent of the fee collected may be used to pay
71 advertising agency costs. The remainder of the fee shall be used
72 by the district school board for school transportation purposes.
73 2. Only one individual or business entity may place
74 advertisements on a school bus.
75 (b) The design, placement, and size of signage on the
76 exterior of a school bus acknowledging the advertiser shall be
77 prescribed by rule of the State Board of Education.
78 Section 4. Paragraph (a) of subsection (1) of section
79 1011.68, Florida Statutes, is amended to read:
80 1011.68 Funds for student transportation.—The annual
81 allocation to each district for transportation to public school
82 programs, including charter schools as provided in s.
83 1002.33(17)(b), of students in membership in kindergarten
84 through grade 12 and in migrant and exceptional student programs
85 below kindergarten shall be determined as follows:
86 (1) Subject to the rules of the State Board of Education,
87 each district shall determine the membership of students who are
88 transported:
89 (a)1. By reason of living 2 miles or more from an
90 elementary school that enrolls any combination of students in
91 kindergarten through grade 5.
92 2. By reason of living 3 miles or more from a middle school
93 or a high school that enrolls any combination of students in
94 grades 6 through 12.
95 Section 5. This act shall take effect July 1, 2010.
