Florida Senate - 2023 SB 1642 By Senator Simon 3-01823B-23 20231642__ 1 A bill to be entitled 2 An act relating to the Florida High School Athletic 3 Association; amending s. 1006.20, F.S.; requiring the 4 Florida High School Athletic Association, in 5 consultation with its Sports Medicine Advisory 6 Committee, to adopt bylaws to establish requirements 7 for the provision of health care services to student 8 athletes; requiring that such health care services be 9 as comprehensive as practicable; requiring that the 10 bylaws, at a minimum, require member schools, when 11 practicable, to hire or contract with qualified health 12 care providers to provide health care services to 13 certain student athletes and provide for the legally 14 compliant collection, review, and storage of student 15 athlete health information; providing an effective 16 date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Paragraph (n) is added to subsection (2) of 21 section 1006.20, Florida Statutes, to read: 22 1006.20 Athletics in public K-12 schools.— 23 (2) ADOPTION OF BYLAWS, POLICIES, OR GUIDELINES.— 24 (n) The FHSAA, in consultation with its Sports Medicine 25 Advisory Committee, shall adopt bylaws to establish requirements 26 for the provision of health care services to student athletes by 27 member schools. Required health care services for student 28 athletes must be as comprehensive as practicable. At a minimum, 29 the bylaws must require that member schools, when practicable: 30 1. Hire or contract with a qualified health care provider 31 to provide health care services to student athletes 32 participating in collision and contact sports as defined by the 33 sports medicine advisory committee established under paragraph 34 (m). 35 2. Provide for the legally compliant collection, review, 36 and storage of student athlete health information, including, 37 but not limited to, preparticipation screenings and written 38 medical clearance to return for student athletes. 39 Section 2. This act shall take effect July 1, 2023.
