    1                        A bill to be entitled                      
    2         An act relating to the disposition of traffic
    3         infractions; amending s. 318.21, F.S.; authorizing
    4         local governments to impose a surcharge on school zone
    5         traffic violations to fund school crossing guard
    6         programs; requiring that the surcharge be imposed
    7         pursuant to an ordinance requiring public hearings;
    8         providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Paragraph (a) of subsection (11) of section
   13  318.21, Florida Statutes, is amended to read:
   14         318.21 Disposition of civil penalties by county courts.—All
   15  civil penalties received by a county court pursuant to the
   16  provisions of this chapter shall be distributed and paid monthly
   17  as follows:
   18         (11)(a) A county or municipality may, by majority vote of
   19  the governing board of the respective county or municipality,
   20  impose a surcharge on parking fines and school zone traffic
   21  violations for the sole purpose of funding school crossing guard
   22  programs; however, the governing body may set aside funds from
   23  this surcharge to pay for startup costs and recurring
   24  administrative costs related to printing new tickets or other
   25  means of implementing the program. The surcharge must be
   26  authorized by ordinance requiring public hearings.
   27         Section 2. This act shall take effect July 1, 2012.
