    1                        A bill to be entitled                      
    2         An act relating to motor vehicle traffic infractions;
    3         amending s. 318.18, F.S.; clarifying that upon
    4         presentation of an affidavit of compliance following
    5         issuance of a traffic citation relating to motor
    6         vehicle equipment, the offender is subject to a
    7         dismissal fee rather than fine; providing an effective
    8         date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Paragraph (c) of subsection (2) of section
   13  318.18, Florida Statutes, is amended to read:
   14         318.18 Amount of penalties.—The penalties required for a
   15  noncriminal disposition pursuant to s. 318.14 or a criminal
   16  offense listed in s. 318.17 are as follows:
   17         (2) Thirty dollars for all nonmoving traffic violations
   18  and:
   19         (c) For all violations of ss. 316.2935 and 316.610.
   20  However, for a violation of s. 316.2935 or s. 316.610, if the
   21  person committing the violation corrects the defect and obtains
   22  proof of such timely repair by an affidavit of compliance
   23  executed by the law enforcement agency within 30 days from the
   24  date upon which the traffic citation was issued, and pays $4 to
   25  the law enforcement agency, thereby completing the affidavit of
   26  compliance, then upon presentation of said affidavit by the
   27  defendant to the clerk within the 30-day time period set forth
   28  under s. 318.14(4), the dismissal fee fine must be reduced to
   29  $10, which the clerk of the court shall retain.
   30         Section 2. This act shall take effect July 1, 2012.
