ENROLLED 2022 Legislature SB 7002, 1st Engrossed 20227002er 1 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 381.987, F.S., which 4 provides an exemption from public records requirements 5 for certain information of patients, caregivers, and 6 qualified physicians held by the Department of Health 7 relating to the medical use of marijuana; removing the 8 scheduled repeal of the exemption; making technical 9 changes; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsections (1) and (6) of section 381.987, 14 Florida Statutes, are amended to read: 15 381.987 Public records exemption for personal identifying 16 information relating to medical marijuana held by the 17 department.— 18 (1) The following information held by the department is 19 confidential and exempt from s. 119.07(1) and s. 24(a), Art. I 20 of the State Constitution: 21 (a) A patient’s or caregiver’s personal identifying 22 informationheld by the departmentin the medical marijuana use 23 registry established under s. 381.986, including, but not24limited to, the patient’s or caregiver’s name, address, date of25birth, photograph, and telephone number. 26 (b) All personal identifying information collected for the 27 purpose of issuing a patient’s or caregiver’s medical marijuana 28 use registry identification card described in s. 381.986. 29 (c) All personal identifying information pertaining to the 30 physician certification for marijuana and the dispensing thereof 31held by the department, including, but not limited to,32information related to the patient’s diagnosis, exception33requests to the daily dose amount limit, and the qualified34patient’s experience related to the medical use of marijuana. 35 (d) A qualified physician’s Drug Enforcement Administration 36 number, residential address, and government-issued 37 identification card. 38(6) This section is subject to the Open Government Sunset39Review Act in accordance with s. 119.15 and shall stand repealed40on October 2, 2022, unless reviewed and saved from repeal41through reenactment by the Legislature.42 Section 2. This act shall take effect October 1, 2022.
