Description:

Amends section 560:5-113, Hawaii Revised Statutes, to provide that notice to parents shall not be required if the parents have been served in a proceeding under chapter 587, Hawaii Revised Statutes, and a permanent plan has been ordered by the Court.  (HB1095 HD1)

A BILL FOR AN ACT

 

 

RELATING TO NOTICE OF GUARDIANSHIP PROCEEDINGS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 560:5-113, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Except as otherwise ordered or waived by the court for good cause, if notice of a hearing on a petition is required, other than a notice for which specific requirements are otherwise provided, the petitioner shall give notice of the time and place of the hearing to the person to be notified.  Notice shall be given in compliance with section 560:1-401, at least fourteen days before the hearing[.]; provided that notice to parents shall not be required if the parents have been served in a proceeding under chapter 587 and a permanent plan has been ordered."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2050.
