A BILL FOR AN ACT


 

 

PROPOSING A CONSTITUTIONAL AMENDMENT RELATING TO FUNDING LONG TERM CARE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article VII of the Constitution of the State of Hawaii to authorize the legislature to increase the general excise tax by not more than one percentage point and dedicate the proceeds to funding a state long-term care program as prescribed by the legislature.

     The legislature finds that this Act addresses an urgent need of the State's growing senior population and fulfills an imperative public purpose.

     SECTION 2.  Article VII, of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:

"LONG-TERM CARE

    SECTION  .  The legislature shall have the power to increase the general excise tax by not more than one percentage point and dedicate the proceeds to funding a state long-term care program as prescribed by the legislature."

    SECTION 3.  The question to be printed on the ballot shall be as follows:

"Shall the Constitution of the State of Hawaii be amended to specify that the legislature shall have the power to increase the general excise tax by not more than one percentage point and dedicate the proceeds to funding a state long-term care program as prescribed by the legislature?"

     SECTION 4.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
