A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§291C-     Flood zone; depth gauge signs.  (a)  The department of transportation, or appropriate county agency, shall post a depth gauge sign on any portion of a public highway that:

     (1)  Is under its jurisdiction;

     (2)  Lies within a special flood hazard area; and

     (3)  Is prone to flooding.

     (b)  The depth gauge sign shall be posted in a manner consistent with the Federal Highway Administration's Manual on Uniform Traffic Control Devices, as amended.

     (c)  As used in this section:

     "Depth gauge sign" means a depth gauge or flood gauge sign in conformity with the Federal Highway Administration's Manual on Uniform Traffic Control Devices, as amended.

     "Public highway" shall have the same meaning as in section 264-1.

     "Special flood hazard area" means an area identified as a special flood hazard area by the Federal Emergency Management Agency."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Description:

Requires the posting of depth gauge signs, in a manner consistent with the Federal Highway Administration's Manual on Uniform Traffic Control Devices, on any portion of a public highway that lies within a special flood hazard area and is prone to flooding.  Effective 7/1/2050.  (SD1)
