A BILL FOR AN ACT
relating to leahi hospital.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. One of two healthcare facilities currently under the jurisdiction of the Oahu region of the Hawaii health systems corporation, Leahi hospital has been providing healthcare since 1901. Leahi hospital currently houses a skilled nursing facility, an intermediate care facility, and an adult day health center and provides various healthcare, therapeutic, and social services to individuals within these facilities. Leahi hospital also provides acute healthcare services for tuberculosis patients. While Leahi hospital itself provides the infrastructure that houses these facilities, the Leahi hospital campus consists of a total of four parcels of land. One parcel contains Leahi hospital and is under the direct control of the Oahu region of the Hawaii health systems corporation; two parcels contain facilities that house branches and programs under the jurisdiction of the department of health; and one parcel is a vacant lot under the jurisdiction of the University of Hawaii.
The legislature finds this current system of multiple entities having jurisdictional control over the Leahi hospital campus and its facilities to be inefficient use of resources that may be better put to other purposes. As such, the legislature finds that plans should be developed to transfer all parcels of land contained within the Leahi hospital campus to the Hawaii health systems corporation.
The purpose of this Act is to establish a working group to formulate a plan for the transfer of all parcels of land contained within the Leahi hospital campus to the Hawaii health systems corporation.
SECTION 2. (a) The department of health shall convene a working group to develop a plan to transfer all parcels of land currently contained within the Leahi hospital campus to the Hawaii health systems corporation.
(b) The working group shall be composed of:
(1) The director of health, or the director's designee, who shall serve as the chair of the working group;
(2) The chief executive officer of the Oahu regional health care system of the Hawaii health systems corporation, or the chief executive officer's designee;
(3) A member of the board of directors of the Hawaii health systems corporation, other than the director of health or the chief executive officer of the Oahu regional health care system, appointed by the governor;
(4) The chairperson of the board of regents of the University of Hawaii, or the chairperson's designee;
(5) The president of the University of Hawaii, or the president's designee;
(6) A member who is a resident of the neighborhood surrounding Leahi hospital, appointed by the governor; and
(7) Any other member deemed appropriate by the director of health.
(c) In developing the plan for the transfer of parcels of land contained within the Leahi hospital campus, the working group shall:
(1) Determine the exact boundaries of the parcels of land under the jurisdiction of the Oahu region of the Hawaii health systems corporation, the department of health, and the University of Hawaii;
(2) Determine the current users of any of the facilities located on the parcels of land and the effects, if any, the transfer of the parcels of land will have on these users;
(3) Investigate any barriers to the transfer of the parcels of land not currently under the jurisdiction of the Oahu region of the Hawaii health systems corporation to the Hawaii health systems corporation and make recommendations to address these barriers;
(4) Determine the financial costs of transferring the parcels of land to the Hawaii health systems corporation;
(5) Determine the effects, if any, the transfer of the parcels of land will have on the Hawaii health systems corporation, the department of health, and the University of Hawaii;
(6) Investigate any other possible uses of the parcels of land, including development of the land through public-private partnerships;
(7) Determine any expected benefits, financial or otherwise, that may occur with the transfer of the parcels of land;
(8) Identify any statutory changes necessary to effectuate the transfer of the parcels of land contained within the Leahi hospital campus; and
(9) Consider any other issue or objective deemed necessary by the director of health or the working group.
(d) The working group shall submit:
(1) A preliminary report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to convening of the regular session of 2016; and
(2) A final report of its findings and recommendations, including any proposed legislation, to the legislature no later than the twenty days prior to the convening of the regular session of 2017.
(e) No member shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of the working group.
(f) The working group convened pursuant to this Act shall cease to exist on June 30, 2017.
SECTION 3. This Act shall take effect upon its approval.
