A BILL FOR AN ACT

 

 

proposing an amendment to the hawaii constitution to permit the president of the senate and speaker of the house of representatives to appoint members to the board of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article X, section 2 of the Hawaii State Constitution to permit the president of the senate and speaker of the house of representatives to appoint members to the board of education, as provided by law.

     SECTION 2.  Article X, section 2, of the Constitution of the State of Hawaii is amended to read as follows:

     "BOARD OF EDUCATION

     Section 2.  There shall be a board of education.  The governor, president of the senate, and speaker of the house of representatives, as provided by law, shall nominate and, by and with the advice and consent of the senate, appoint the members of the board of education[, as provided by law]."

     SECTION 3.  The question to be printed on the ballot shall be as follows:

     "Shall the President of the Senate and Speaker of the House of Representatives, in addition to the Governor, be permitted to appoint members, as provided by law, to the Board of Education?"

     SECTION 4.  Constitutional material to be repealed is bracketed and stricken.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
