A BILL FOR AN ACT
RELATING TO MEDICINE AND SURGERY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§453- Visiting sports team physician; licensure exemption. (a) A physician who is licensed in good standing to practice in another state shall be exempt from the licensure requirements of this chapter while practicing in this State if either of the following apply:
(1) The physician has a written or oral agreement with a sports team to provide care to the team members and coaching staff traveling with the team to the State for a specific sporting event to take place in this State; or
(2) The physician has been invited by a national sport governing body to provide services to team members and coaching staff at a national sport training center in this State or to provide services at an event or competition in this State that is sanctioned by the national sport governing body; provided that:
(A) The physician's practice is limited to that required by the national sport governing body; and
(B) The services provided by the physician shall be within the area of the physician's competence.
(b) A physician who is exempt under subsection (a) from licensure may not:
(1) Provide care or consultation to any person residing in this State other than persons described in subsection (a) or as otherwise provided by state law; or
(2) Practice at a health care clinic or health care facility in the State, including an acute care facility.
(c) The duration for an exemption under subsection (a) shall be as follows:
(1) An exemption under subsection (a)(1):
(A) Shall be effective while the physician is traveling with the sports team in the State; and
(B) Shall not extend beyond ten days per sporting event; provided that:
(i) A maximum of twenty additional days per sporting event may be granted by the Hawaii medical board; and
(ii) The total period of exemption does not exceed thirty days; and
(2) An exemption under subsection (a)(2) shall be effective during the time certified by the national sport governing body; provided that the exemption may not exceed thirty days.
(d) The Hawaii medical board may enter into agreements with the medical licensing boards of other states to implement this section. Agreements may include procedures for reporting potential medical license violations."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2070.
