A BILL FOR AN ACT

 

 

RELATING TO PROCUREMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103D-    Reports to the legislature.  No later than twenty days prior to the convening of each regular session, each governing body shall submit to the legislature an annual report, covering the most recently completed fiscal year, that summarizes every contract in excess of $50,000 entered into by the governing body pursuant to this chapter."

     SECTION 2.  Chapter 103F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103F-    Reports to the legislature.  No later than twenty days prior to the convening of each regular session, each governing body shall submit to the legislature an annual report, covering the most recently completed fiscal year, that summarizes every contract in excess of $50,000 entered into by the governing body pursuant to this chapter."

     SECTION 3.  Section 103D-305, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  Procurements of [$25,000] $50,000 to less than $250,000 shall be made in accordance with small purchase procedures; provided that such small purchase procurements through an electronic system shall be required."

     SECTION 4.  Section 103F-405, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§103F-405[]] Small purchases.  Purchases  of health and human services of less than [$25,000] $50,000 are small purchases, and shall be made in accordance with section 103D-305 and rules adopted by the policy board to implement that section."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2016.

Description:

Requires annual reports to the legislature for procurement contracts that exceed $50,000.  Raises the minimum threshold requirement for electronic system procurement requirements in chapter 103D from $25,000 to $50,000.  Increases the minimum threshold for small purchases under chapter 103F from $25,000 to $50,000.
