A BILL FOR AN ACT

 

 

relating to mail.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 481B, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§481B-     Deceptive mail.  No person, firm, partnership, association, or corporation, or agent or employee thereof, shall distribute unsolicited mail that is reasonably likely to cause the recipient to believe that a governmental agency is the source of the mail or has otherwise approved of the distribution; provided that this section shall not apply to any government agency or any person, firm, partnership, association, or corporation, or agent or employee thereof, authorized to distribute mail on behalf of a government agency."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
