A BILL FOR AN ACT
RELATING TO AGRICULTURE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 149A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§149A- Pesticide
inspection program; restricted use pesticides; banned pesticides. (a) The department shall establish and implement
a pesticide inspection program to:
(1) Increase compliance
with proper use of restricted use pesticides; and
(2) Ensure the
continued prohibition on the use or application of pesticides containing
chlorpyrifos pursuant to section 149A-31(7).
(b) In establishing the pesticide inspection
program, the department shall:
(1) Develop a
system to conduct inspections annually or in response to a complaint to
determine if any violations of section 149A-31(3), (4), or (7) were committed;
and
(2) Develop an
online reporting tool for restricted use pesticides, with the data available to
the public.
(c) The department shall post the results of all
pesticide inspections conducted pursuant to this section on the department's
website and update the results upon completion of each inspection.
(d) The department shall adopt rules pursuant to chapter 91 necessary for the implementation of this section."
SECTION 2. New statutory material is underscored. SECTION 3. This Act shall take effect on July 1, 3000.
