A BILL FOR AN ACT
Relating to facilities funding for charter schools.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that facilities funding has been a long-standing issue for charter schools nationally and locally. In Hawaii, start-up charter schools have paid the costs of their facilities from operational funds. However, Act 159, Session Laws of Hawaii 2013, authorized the state public charter school commission to request facilities funding as part of its annual budget request to the director of finance beginning with the 2014-2015 fiscal year.
The legislature further finds that the state public charter school commission is currently implementing a facilities pilot project to provide funds to various charter schools for small-scale facilities projects, with funding allocation based, in part, on the need and performance of the charter schools. The commission has currently allocated $680,000 of federal impact aid to this pilot program.
The purpose of this Act is to appropriate funds to the state public charter school commission to support its facilities pilot project.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for the state public charter school commission to provide funding to charter schools for facilities projects, with funding allocation based, in part, on the need and performance of the charter schools.
The sums appropriated shall be expended by the state public charter school commission for the purposes of this Act.
SECTION 3. The state public charter school commission shall report to the legislature no later than twenty days prior to the convening of each regular session, beginning with the regular session of 2016, and ending with the regular session immediately following the end of the state public charter school commission's pilot project. The commission shall report on the use of the funds appropriated under this Act and the findings, conclusions, and recommendations of the state public charter school commission's facilities pilot project.
SECTION 4. This Act shall take effect on July 1, 2015.
