A BILL FOR AN ACT
RELATING to pesticides.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 149A-51, Hawaii Revised Statutes, is amended to read as follows:
"§149A-51 Advisory committee.
(a) There shall be an advisory committee on pesticides composed of but
not limited to the chairperson, or the chairperson's designated representative,
who shall head the committee and one representative each from the department of
health, department of land and natural resources, department of education,
University of Hawaii college of tropical agriculture and human resources, [sugar
industry,] each county mayors' office, Hawaii Farmers Union United,
pineapple industry, Hawaii Farm Bureau Federation, pesticide industry,
structural pest control industry, an environmental organization, a citizen
group, [and] a landscape professional[.], a medical expert,
and a non-governmental organization scientist. Members of the advisory
committee shall be appointed by the governor from a list of persons recommended
by the respective agencies and industries in accordance with section 26-34.
(b) The committee shall advise and assist the department in developing or revising laws and rules to carry out and effectuate the purposes of this chapter and in advising the department in pesticide problems. Specifically, the committee shall:
(1) Establish state standards for chronicity to account for low-level continuous exposures;
(2) Evaluate and recommend to the legislature specific changes to the State's pesticide laws and regulations;
(3) Revise and expand the Kauai agricultural good neighbor program statewide; and
(4) Establish a comprehensive buffer zone policy for the State.
For purposes of this section, "chronicity" means the degree to which pesticide exposure at levels lower than acute exposure thresholds can cause harmful chronic and compounding effects."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.

Expands the membership of the pesticide advisory committee to include a representative from the DOE, each county mayors' office, a medical expert, and a non-governmental organization scientist.
