A BILL FOR AN ACT

relating to frozen food product labeling.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that some vendors circumvent the intent of the law applicable to the labeling of previously frozen fish by displaying the information on the label in such fine print that the information is not "easily seen under customary conditions of purchase," as the law requires. Specifying a minimum letter size for this labeling requirement will prevent vendors from making this information unclear or inconspicuous.

The purpose of this Act is to clarify labeling requirements for the sale of frozen food products in general.

SECTION 2. Section 328-62, Hawaii Revised Statutes, is amended to read as follows:

"§328-62 Description of label. "Label" means the information required in this part to be placed on any food products by means of a stamp, stencil, or printing by machine, or by attaching to the immediate package, by sign, handbill, placard, or otherwise, the words "PREVIOUSLY FROZEN" in letter size [~~easily seen under customary conditions of purchase.~~] not less than seventy-five per cent of the size of the font that is used for the main text of the label."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
