HOUSE CONCURRENT

RESOLUTION

REQUESTING THAT THE DEPARTMENT OF TRANSPORTATION AND THE CITY AND COUNTY OF HONOLULU DEPARTMENT OF TRANSPORTATION SERVICES ADDRESS THE probLEM OF abandoned shopping carts on Oahu.

WHEREAS, on any given day, shopping carts may be seen discarded, strewn, and abandoned in communities across Oahu: some carts are left in beach parks and on sidewalks and roadways, while others are abandoned in brush and streams and near bus stops and at people's homes; and

WHEREAS, shopping carts that lie abandoned on Oahu's sidewalks and roadways and throughout communities jeopardize the safety of drivers who must navigate around these carts and pedestrians who must walk on the street to avoid them, and make it especially difficult for persons in wheelchairs to move about; and

WHEREAS, abandoned shopping carts are a nuisance to businesses and establishments, customers, property owners, police and other law enforcement, and the public; and

WHEREAS, these carts become rusty, dirty, and damaged when left to the natural elements and often contain discarded or abandoned items or trash that also pose health and safety hazards; and

WHEREAS, besides being safety and health hazards, abandoned shopping carts are an eyesore and blight to the environment; and

WHEREAS, returning and replacing abandoned shopping carts comes at great expense to businesses and establishments, such as supermarkets, as well as to consumers to whom the costs are passed on; and

WHEREAS, abandoned shopping carts are detrimental to pedestrian and vehicular traffic; and

WHEREAS, various techniques have been tried to address the problem of abandoned shopping carts, including prohibiting the removal of carts from businesses and establishments or their parking lots; hiring employees or companies to retrieve carts; requiring customers to pay a refundable deposit to use a cart; and installing cart containment systems that lock the wheels of carts when the carts reach the boundary of the establishment's parking lot; and

WHEREAS, requiring businesses and other establishments that own or lease shopping carts to retrieve their abandoned shopping carts will help address this community concern; now, therefore,

BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the Senate concurring, that the Department of Transportation and City and County of Honolulu Department of Transportation Services, respectively, are requested to adopt rules to address the problem of abandoned shopping carts on Oahu, including:

(1) Holding businesses and establishments responsible for retrieving their abandoned shopping carts; and

(2) Providing businesses and establishments with other means of dealing with sidewalk and roadway hazards caused by abandoned shopping carts; and

BE IT FURTHER RESOLVED that the Department of Transportation and City and County of Honolulu Department of Transportation Services are requested to submit separate reports to the Legislature no later than twenty days prior to the convening of the Regular Session of 2020 on the actions taken to address the problem of abandoned shopping carts on Oahu; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, Mayor of the City and County of Honolulu, Director of Transportation, and Director of Transportation Services of the City and County of Honolulu.
