HOUSE CONCURRENT

RESOLUTION

 

 

requesting the auditor to conduct a sunrise analysis on the statutory establishment of flagger certification and training requirements for individuals to provide temporary traffic control in a street, road, or highway.

 

 

 


     WHEREAS, construction zones, particularly those that occur along Hawaii's highways and roadways, are often areas that are active with the movement of large vehicles, construction equipment, personal automobiles, bicyclists, and pedestrians; and

 

     WHEREAS, with the amount of activity around construction zones, it is imperative that traffic safety control measures be in place to protect public safety; and

 

     WHEREAS, a flagger is an individual who directs traffic for construction sites and who often works in conjunction with other flaggers, each holding paddles with "Stop" on one side and "Slow" on the other, which they use to help indicate to motorists to slow down, stop, and pass through a work zone; and

 

WHEREAS, flaggers often work in teams to coordinate traffic flow via communication, either by two-way radio or hand signals, at times using the assistance of orange barrels, cones, vehicle placement, and other devices which they position alongside the roadway to safely control the flow of traffic through a construction area; and

 

     WHEREAS, many jurisdictions require individuals who work as flaggers to be certified and trained according to national standards; and

     WHEREAS, while law enforcement personnel in Hawaii are often used to control traffic around construction zones, individuals are also used to control traffic around construction zones, although these individuals may not have received any formal training and certification; and

 

     WHEREAS, during the Regular Session of 2016, H.B. No. 1560 was introduced to establish training and certification requirements for flaggers; and

 

     WHEREAS, prior to enacting legislation establishing certification and training requirements for individuals to serve as flaggers in Hawaii, the Legislature wishes to first determine the necessity of establishing certification and training requirements; and

 

WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Auditor to analyze legislation being considered for enactment that, if enacted, would subject unregulated professions and vocations to licensing or other regulatory controls; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2016, the Senate concurring, that the Auditor is requested to conduct a sunrise analysis on the statutory establishment of flagger certification and training requirements for individuals to provide temporary traffic control in a street, road, or highway; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit to the Legislature a report of the Auditor's findings and recommendations, including any proposed legislation, no later than twenty days prior to the convening of the Regular Session of 2017; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Acting Auditor.
