HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE AUDITOR TO CONDUCT A REVIEW AND MANAGEMENT AUDIT OF THE DEPARTMENT OF LAND AND NATURAL RESOURCES' MANAGEMENT OF AND ENFORCEMENT EFFORTS AT KAANAPALI BEACH.

 

 

 


     WHEREAS, section 13-251-76, Hawaii Administrative Rules, prohibits any person from engaging in commercial activity in or on Kaanapali ocean waters and beach without a written permit or registration certificate from the Board of Land and Natural Resources or the Board's authorized representatives; and

 

     WHEREAS, the Department of Land and Natural Resources is responsible for enforcing section 13-251-76, Hawaii Administrative Rules, and other laws and rules relating the use of Kaanapali Beach; and

 

     WHEREAS, concerns have been expressed about unauthorized commercial activities taking place at Kaanapali Beach; and

 

     WHEREAS, there may be a lack of adequate funding for the Department of Land and Natural Resources to effectively enforce laws and rules regarding commercial activities at Kaanapali Beach; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the Auditor is requested to conduct a review and management audit of management and enforcement efforts by the Department of Land and Natural Resources regarding Kaanapali Beach; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to report the Auditor's findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2019; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor; the Chairperson of the Board of Land and Natural Resources; and the Administrator of the Division of Boating and Ocean Recreation and the Enforcement Chief of the Division of Conservation and Resources Enforcement, Department of Land and Natural Resources.
