HOUSE CONCURRENT

RESOLUTION

 

 

Requesting the Department of Health to create rules to allow dogs to accompany owners in outdoor dining areas and the workplace.

 

 

 


     WHEREAS, the Department of Health has previously interpreted Administrative Rules §11-12-47(e) to prevent dogs from being allowed in outdoor dining areas of restaurants; and

 

     WHEREAS, numerous restaurants in Hawaii support and allow dog owners to bring their dogs to dine in outdoor dining areas; and

 

     WHEREAS, in Hawai’i, 40% of the households share their homes and lives with dogs for a total of 206,130 dogs. This number keeps increasing as individuals realize how important animal companionship is in making our lives whole; and

 

     WHEREAS, many enlightened jurisdictions currently allow dogs to dine outdoors with their families with the restaurant owner’s consent; and

 

     WHEREAS, allowing dogs to dine with their owners in outside dining areas could help in offsetting the tough economic times as an owner who is taking their dog for a walk can stop by a restaurant and have a meal, instead of taking their dog home before eating; and

 

     WHEREAS, dogs are recognized as playing a vital role in improving and enhancing the lives of people and improving the quality of life for many, especially those suffering from illnesses; and

 

     WHEREAS, the comfort and improvement in a dog owners quality of life can be translated to the workplace, if they are allowed to have their dogs with them; and

 

     WHEREAS, some communities, such as San Diego, understand the importance of animals in our daily lives and activities and have dedicated beaches for sole use by dogs and their owners; and

 

     WHEREAS, some communities, such as the City and County of Honolulu have dedicated parks for sole use by dogs and their owners; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Department of Health is urged to create rules to allow dogs to dine with their owners in outside dining areas, with the restaurant's consent; and

 

     BE IT FURTHER RESOLVED the Department of Health is urged to create rules to allow dogs to be brought into the workplace with the employer's consent; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of the Department of Health.
