HOUSE CONCURRENT
RESOLUTION
requesting the department of education to implement a statewide PLAN to eliminate the waste of milk distributed with school lunches.
WHEREAS, 42 United States Code 1758 requires that schools participating in the National School Lunch Program offer students fluid milk in a variety of fat contents with their school lunches; and
WHEREAS, the National School Lunch Program currently allows substitutions and waivers of the fluid milk requirement under certain circumstances, such as students with disabilities, medical needs, or special dietary needs; and
WHEREAS, few students in Hawaii public schools are awarded substitutions and waivers for milk and, according to the Department of Education, conditions such as lactose intolerance do not qualify students for waivers; and
WHEREAS, some of the milk that is distributed with school lunches in Hawaii's public schools is not consumed and is thrown away instead, wasting valuable state funds and opportunities for students to consume nutritious beverages with their lunches; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the Senate concurring, that the Department of Education is urged to develop and implement a statewide plan using existing resources to eliminate the waste of milk that is distributed with school lunches by the 2010-2011 school year; and
BE IT FURTHER RESOLVED that the Department of Education is requested to provide a report to the Legislature detailing the current amount of milk distributed that is wasted, the statewide plan to eliminate the waste of milk, and an estimate of the resulting cost savings no later than sixty days prior to the first day of instruction of the 2010-2011 school year; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Superintendent of Education, Chairperson of the Board of Education, and the Director of Health.
