HOUSE CONCURRENT
RESOLUTION
REQUESTING A STUDY ON STREET-SIDE PARKING IN WHITMORE VILLAGE, CENTRAL OAHU.
WHEREAS, the Legislature finds that there are vast differences in infrastructure between rural and urban areas of the State; and
WHEREAS, while most of the urban areas of Honolulu and the nearby suburbs have paved sidewalks, many of the rural areas do not; and
WHEREAS, because of the lack of paved sidewalks in rural areas, it is often very difficult to distinguish where the boundaries of private property ends and where county easements for pedestrian travel begins; and
WHEREAS, furthermore, because of a lack of affordable housing, many of our communities have experienced an increase of multiple families sharing a single residence; and
WHEREAS, with multiple families sharing single residences, on-street parking in these communities has become more scarce; and
WHEREAS, in many of these communities, it is not uncommon for three, four, five or more automobiles to be parked in the garages, yards and street areas adjacent to residences; and
WHEREAS, it is currently illegal for motor vehicles to block the county pedestrian easement on a street; and
WHEREAS, however, because enforcement of this law is sporadic at best, many of our citizens are not aware that they maybe violating the law if their motor vehicle is parked in such a way as to extend off the property boundary and into the county pedestrian easement; and
WHEREAS, recently, there has been a crack-down on illegally parked motor vehicles in Whitmore Village, Central Oahu; and
WHEREAS, many of residents in the area who had parked as so have done so for years. . . even decades. . . without any warnings or citations given; and
WHEREAS, recent enforcement actions have outraged many of the residents in Whitmore Village, Central Oahu, who have questioned whether other similarly situated communities are treated the same way; and
WHEREAS, fundamental fairness dictates that similarly situated persons are treated equally under the law; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-Sixth Legislature of the State of Hawaii, the Senate Concurring, that the Department of Transportation, in collaboration with the Department of Transportation Services of the City and County of Honolulu, and the Honolulu Police Department investigate whether enforcement actions in Whitmore Village, Central Oahu, is consistent with enforcement actions in other similarly situated communities throughout Oahu; and
BE IT FURTHER RESOLVED, that the Department of Transportation transmit a report of their findings and recommendations to the Legislature at least twenty days prior to the convening of the Regular Session of 2015; and
BE IT FURTHER RESOLVED that certified copies be transmitted to the Director of Transportation, the Mayor of the City and County of Honolulu, the Director of Transportation Services of the City and County of Honolulu, and the Chief of Police of the Honolulu Police Department.
