HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE AUDITOR TO CONDUCT A SUNRISE REVIEW of THE REGULATION OF pharmacy benefit management companies.

 

 

 


     WHEREAS, H.B. No. 275 (2011) proposes to regulate pharmacy benefit management companies, which are presently unregulated; and

 

     WHEREAS, pharmacy benefit management companies are the intermediaries that negotiate services and costs between pharmaceutical companies and third party payors, such as insurance companies, businesses, and cash-paying customers; and

 

     WHEREAS, regulation of pharmacy benefit management companies would help stabilize health care costs by enforcing disclosure of drug costs and financial contracts with health care providers; and

 

     WHEREAS, pharmacy providers, such as chain drug stores and independent pharmacies, are currently subjected to unregulated auditing practices, and additional oversight of pharmacy benefit management companies may establish more reliable business practices; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Auditor to review proposals to regulate heretofore unregulated professions, vocations, or occupations; and

 

     WHEREAS, it is imperative that pharmacy benefit management companies be subject to licensing and regulation requirements to reduce health care costs and guarantee health care consumers access to the best possible care; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Auditor is respectfully requested to conduct a sunrise review of the regulation of pharmacy benefit management companies, pursuant to section 26H-6, Hawaii Revised Statutes, as proposed to be regulated under H.B. No. 275 (2011); and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations to the Legislature not later than twenty days prior to the convening of the Regular Session of 2012; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Director of Commerce and Consumer Affairs.
