HOUSE RESOLUTION
supporTING A REQUIREMENT THAT INSTRUCTIONAL HOURS BE COLLECTIVELY BARGAINED.
WHEREAS, since the passage of Act 167, Session Laws of Hawaii 2010, schools across Hawaii have been working towards implementing a bell schedule to conform to section 302A-251, Hawaii Revised Statutes; and
WHEREAS, section 302A-251, Hawaii Revised Statutes, currently requires all public elementary schools in the State, excluding charter schools and multi-track public schools, to implement a school year that includes nine hundred fifteen student instructional hours; and
WHEREAS, section 302A-251, Hawaii Revised Statutes, also requires all public secondary schools, excluding charter schools and multi-track public schools, to implement a school year that includes nine hundred ninety student instructional hours for the 2014-2015 school year; and
WHEREAS, school administrators and teachers have made a good faith effort to implement these requirements, including spending a great amount of time on numerous meetings and developing plans; and
WHEREAS, despite this good faith effort, many secondary schools are having difficulty in implementing their bell schedules to comply with these requirements; and
WHEREAS, many elementary and secondary schools are also forced to use opening, closing, homeroom, and study hall time to count as student instructional time for the purposes of section 302A-251, Hawaii Revised Statutes; and
WHEREAS, the Legislature believes that decisions regarding instructional time are best accomplished through a process that includes input from teachers and school administrators; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-seventh Legislature of the State of Hawaii, Regular Session of 2014, that the Legislature supports a requirement that instructional hours be subject to the collective bargaining process and negotiated between the Hawaii State Teachers Association and the Board of Education; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the Board of Education, the Superintendent of Education, and the President of the Hawaii State Teachers Association.
