A BILL FOR AN ACT

 

 

relating to public employees.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§78-    Public employees; settlement terms.  If a public employee retires or otherwise leaves public employment while the public employee is the subject of criminal charges, allegations of misconduct or improper behavior or actions, or a federal criminal investigation, any financial settlement reached between the employee and public employer shall not exceed an amount equal to the lesser of the employee's annual salary or $50,000; provided that a settlement in excess of that amount may be offered to the public employee, however no excess settlement moneys shall be released to the employee until a final determination is made that the employee is innocent or cleared of any wrongdoing.

     For the purposes of this section, "public employee" means any public employee of the State or any county, and the political subdivisions and agencies thereof, any employees under contract with the State or county, any civil service employees, and any probationary or provisional employees of the State or county."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
