A BILL FOR AN ACT
RELATING TO ALBIZIA.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
The legislature further finds that albizia trees have very brittle trunks and limbs that are structurally weak and are prone to "sudden limb shear", a phenomenon in which live branches collapse without warning or apparent cause. These collapses can occur even if the tree appears to be healthy. This phenomenon, combined with the tree's large size and fast growth, gives the tree the potential to cause major damage to property, infrastructure, and human life. As a result, state and county agencies and utility companies must constantly remove albizia trees. There are currently few beneficial uses for the removed albizia trees.
However, the legislature finds that there may be a number of beneficial uses for albizia wood. For example, in 2018, a former university of Hawaii student led a team that successfully constructed a full-size prototype single-family home built from albizia wood. The project demonstrated that albizia could be used as a locally sourced building material. The team indicated that there remained questions about whether the use of albizia wood for construction was economically feasible and whether builders could achieve economies of scale using the wood. If questions like these are answered, the State could turn its overabundance of albizia trees into economic opportunities.
Accordingly, the purpose of this Act is to require the department of business, economic development, and tourism to:
(1) Create a grant program to assist persons who use albizia trees to create usable products or are developing new ways to use albizia trees to create usable products; and
(2) Study economically feasible ways in which businesses may use albizia trees to produce usable products, including housing, throughout the State.
SECTION 2. Chapter 201, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§201-
Albizia products; grant
program. (a)
The department shall establish a grant program to assist persons who:
(1) Use albizia trees to create usable commercial
products; or
(2) Are developing new ways of using albizia
trees to create usable commercial products.
(b) The department shall adopt
rules pursuant to chapter 91 that establish criteria for the award of grant
funding and implement a process to facilitate the award of grants. The rules shall include the following terms
and conditions, at a minimum:
(1) The products being created,
developed, or studied shall primarily use albizia wood. For purposes of this paragraph, whether a
product primarily uses albizia wood shall be determined pursuant to guidelines
established by rule;
(2) Qualifying applicants shall include
corporations, limited liability companies, partnerships, sole proprietorships,
non-profit organizations, and cooperatives having a certificate of vendor
compliance with Hawaii compliance express; and
(3) The manufacture and assembly of the products
shall take place within the State.
(c) Grants shall be awarded
subject to the availability of funds. No
person shall receive grants, in aggregate, that exceed $ in a single calendar year.
(d) No later than twenty days
prior to the convening of each regular session, the department shall submit
to the legislature a report describing the results of the grant program,
including the total number of grants awarded and a summary of the products created
or developed using grant moneys."
SECTION 3. (a) The department of business, economic development, and tourism shall study economically feasible ways in which businesses may use albizia trees to produce usable commercial products, including housing, throughout the State.
(b) In conducting the study, the department shall consult with the university of Hawaii college of tropical agriculture and human resources and the university of Hawaii school of architecture.
(c) The department of business, economic
development, and tourism shall submit a report of its findings and
recommendations, including any proposed legislation, to the legislature no
later than twenty days prior to the convening of the regular session of 2024.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 for the grant program established by section 2 of this Act.
The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2023.
