A BILL FOR AN ACT
RELATING TO PROSTITUTION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§712- Solicitation of prostitution near schools or public parks. (1) A person commits the offense of solicitation of prostitution near schools or public parks if, within seven hundred fifty feet of the real property comprising a school or a public park, the person offers or agrees to pay a fee to another person to engage in sexual conduct.
(2) A person who violates this section shall be guilty of a misdemeanor.
(3) For purposes of this section:
(a) "School" has the same meaning as in section 712-1249.6(6); and
(b) "Sexual conduct" has the same meaning as in section 712-1200(2)."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2011.
