A BILL FOR AN ACT
RELATING TO THE UNIVERSITY OF HAWAII.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part III, subpart A to be appropriately designated and to read as follows:
"§304A- Research
faculty; salary. (a) Not less than twenty-five per cent of a research
faculty's salary shall be paid out of the extramural funds and research and training
revolving fund generated by the research unit at which the research faculty works
or holds tenure.
(b) All grants, contracts, and agreements applied
for or entered into beginning on July 1, 2021, regardless of what they may be
called, that provide for extramural funds for use by a research faculty shall
include an express provision allowing the extramural funds to be used to pay
for the research faculty's salary.
(c) For the purposes of this section:
"Extramural funds"
means moneys received through grants or contracts.
"Research faculty"
means a faculty member who:
(1) Conducts
research;
(2) Does not
instruct students; and
(3) Is classified as "R" faculty."
SECTION 2. Section 304A-2253, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) There is established a University of Hawaii research and training revolving fund into which shall be deposited one hundred per cent of the total amount of indirect overhead revenues generated by the university from research and training programs. The board of regents is authorized to expend one hundred per cent of the revenues deposited in the fund for:
(1) Research and training purposes that may result in additional research and training grants and contracts;
(2) Facilitating
research and training at the university; [and]
(3) Further deposit
into the discoveries and inventions special fund[.]; and
(4) Salary of research faculty. For the purposes of this subsection, "research faculty" shall have the same meaning as defined in section 304A- ."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
