A BILL FOR AN ACT

 

 

relating to urban renewal.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46‑    Urban renewal.  (a)  The council of each county shall enact the necessary ordinances to permit the establishment of special purpose overlay districts for the purpose of creating incentives for urban renewal consistent with the county's long-range, comprehensive general plan adopted pursuant to section 46-4(a); provided that special purpose overlay districts may incorporate tax incentives or waivers of state or county zoning, building, or other regulations.

     (b)  For the purposes of this section, "urban renewal" means:

     (1)  New job and housing opportunities;

     (2)  Economic development and crime reduction;

     (3)  Development or improvement of public facilities including libraries, theaters, parks, youth centers, bike paths, and greenbelts;

     (4)  Landscaping of neighborhood streets with trees or shrubs;

     (5)  Improvements of street lights, storm drains, and water systems;

     (6)  Reduced through traffic on residential streets;

     (7)  New cultural, shopping, or recreational opportunities;

     (8)  Restoration of community pride; and

     (9)  Increase of county revenues to provide greater public safety and services."

     SECTION 2.  (a)  There is created in the department of land and natural resources for administrative purposes only, the urban renewal task force to investigate the need for redevelopment in urban areas in each of the counties and to make recommendations for implementing a state-wide plan for urban renewal.

     (b)  The urban renewal task force shall be composed of:

     (1)  The mayor of the county of Hawaii or the mayor's designee;

     (2)  The mayor of the city and county of Honolulu or the mayor's designee;

     (3)  The mayor of the county of Kauai or the mayor's designee;

     (4)  The mayor of the county of Maui or the mayor's designee;

     (5)  The chairperson of the board of land and natural resources or the chairperson's designee; and

     (6)  The director of transportation or the director's designee;

provided that the governor, the speaker of the house of representatives, and the president of the senate shall each appoint one member in addition to those specified in paragraphs (1) through (6); provided further that the governor shall appoint two additional members of the task force who shall be representatives of the real estate development industry.  Members of the task force shall serve without compensation for their service but shall be reimbursed for expenses incurred in traveling between islands for the purpose of performing their duties under this Act.

     (c)  The urban renewal task force shall meet a minimum of five times between July 1, 2011, and June 30, 2012, and shall be dissolved on June 30, 2012.

     (d)  The department of land and natural resources shall provide administrative support to the urban renewal task force.

     (e)  The members of the urban renewal task force shall elect a chair from among the members and shall adopt rules and procedures for the internal workings of the group. 

     (f)  The urban renewal task force shall investigate and assess the urban renewal and redevelopment needs of each county including the need for:

     (1)  New job and housing opportunities;

     (2)  Economic development and crime reduction;

     (3)  Development or improvement of public facilities including libraries, theaters, parks, youth centers, bike paths, and greenbelts;

     (4)  Landscaping of neighborhood streets with trees or shrubs;

     (5)  Improvements of street lights, storm drains, and water systems;

     (6)  Reduced through traffic on residential streets;

     (7)  New cultural, shopping, or recreational opportunities;

     (8)  Restoration of community pride; and

     (9)  Increase of county revenues to provide greater public safety and services.

     (g)  The urban renewal task force shall investigate and assess the need or desirability of the creation of a state-level redevelopment agency with the power to:

     (1)  Receive and spend funds from the State and other public and private funding sources;

     (2)  Help improve public infrastructure and facilities;

     (3)  Prepare sites for development;

     (4)  Receive, hold, transfer, and develop land;

     (5)  Initiate measures to create incentives for private development;

     (6)  Regulate land use; and

     (7)  Preserve, rehabilitate, and produce affordable housing for low- and moderate-income residents.

     (h)  The urban renewal task force shall designate potential redevelopment project areas in each county and identify the specific needs of each area.  For each county, the urban renewal task force shall propose the creation of special purpose overlay districts to create incentives for redevelopment projects that address the particular needs of each identified project area.

     (i)  The urban renewal task force shall submit a report to the legislature no later than twenty days prior to the convening of the 2012 regular session that includes:

     (1)  A summary of the identified urban renewal or redevelopment needs of each county;

     (2)  A summary of the assessment of the need for and desirability of a state-level redevelopment agency including identification of potential issues involved in implementation;

     (3)  A map or plan of proposed special purpose overlay districts for each county and an explanation of the needs to be met and the incentives to be offered in each overlay district; and

     (4)  Proposals for new or amended state laws, county ordinances, and agency rules necessary to effectuate the recommendations of the task force.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 to fund the allowable travel expenses of the urban renewal task force.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.


     SECTION 5.  This Act shall take effect on July 1, 2011.
